Ford doesn't make tires...they make the roll over prove vehicle that the tread separating Firestone tires were on.

They came out with the 'AD' that told drivers not to over correct at speed, and replaced the tires...and yes I have a 2000 exploder that's never flipped.:ph34r:

Final report could take up to a year to come out so no, no one KNOWS it was 'just' pilot error...we're speculating and sharing opinions...it's not a fight, it's a discussion.

From what is known at this time, several people familiar with aircraft accident causes have voiced an opinion...it would change I'm sure if when the final report comes out a cause other than what is being discussed is spotlighted.

In the mean time several areas of concern are being talked about, and hopefully some learning is going on too.

Cessna may not have made the part that failed, just like ford didn't make the tires. how many times do you hear pilot error..that may be the cause but you have to wonder how many times they have not found the real problem and the pilot is blamed...I think the suit is alittle premature, but i'm sure cessna is well equipped for this...i wonder how much of a percentage off each plane goes to cover legal battles? has there ever been a jump plane crash with fatatilities that there wasn't a law suit?..tony

I'm reluctant to propose blanket language in this forum. There are too many variables - i.e., specifically what it is you want - which you should discuss with the lawyer who will draft or amend your will. Tell him, in your own everyday language, the bottom line of what you want to accomplish, and then let him draft language that he feels is best to make that happen.

Generally, commanding your executor not to file suit on behalf of your estate ought to be fairly simple and straightforward to do. But how to request that your relatives not file suit on their own behalves (which you have no authority to directly control) is another thing; and how to try to "compel" them not to by imposing "consequences" (like disinheriting them, etc.) if they do, is yet another. You need to discuss this with your own lawyer.

Generally speaking, in most states, the basic idea in drafting specific instructions in a will, in order to have them stand up in court, is simply to make them as clear, unequivocal and without ambiguity as possible. Most instructions don't require a specific "formula" of language, but some do, so consult your lawyer.
