Withholding DZ staff paychecks.

I recently heard that a certain DZ would be withholding their staff paychecks in order to perform maintenance on their hanger and airplane. Seems to me that this isn't the best way to keep employees and may very well be an illegal business practice. Any of you human resource/lawyer types have any more specific knowledge about the implications of something like this, beyond it just being a pretty crappy way to treat employees?

If they are closing their doors and declaring bankruptcy, the staff may be screwed (seen that happen a few times to some friends o' mine :()

If not, it's pretty easy if you have internet access to look up labor laws for your state on timely pay.

Well, from where I come from this doesn't seem to be a very smart business move on the dzo's part.

And, for employees, this is good to know

I’m sure that labor laws are different in every state. I live in the state of Indiana and that IS illegal in this state. I also happen to know that the employer can be hit with a class B misdemeanor for every day past pay day, and every employee is a separate count. Plus I believe they would have to pay an additional 10% to each employee for every day past.
I am NOT a lawyer and the only reason I know any of this is because myself and several other employees had gone through this same thing several years ago.

Alot of businesses get around alot of labor laws by only hiring independent contractors... and filling out 1099... It sucks but that way they dont have to pay MOST of the things like Workers Compensation.... Unemployment taxes...medical... you name it.

is this a local DZ to you(Indiana)? It makes a big difference. In Indiana I think unless there is information provided in writing as to dates of pay, as shitty as it maybe, the employer can choose"when to provide payment to his employers. It is shitty and low-life to do, it can be thought of sort of like sales commissions in a sales job. They can be paid monthly,quarterly etc. I agree move on to another DZ if it is where you jump. I am now living in Illinois but have jumped at all the Indiana DZ(except Ft Wayne if it's still there). PM me when you get this I would be curious to hear the details.
