So thats why people dont like cops

What ever you do Do not speed in VA! Actually dont drive in VA with out of state tags, period! Im in Chesapeake for a school, there are 8 in my class and so far 6 of them have gotten pulled over. 5 by the same cop. Every one of them was doing roughly 5 miles over the speed limit, if that but this particular cop writes them up for at least 20 over the limit one of them got written up for 30 over and now faces some jail time. When they ask to see the Radar gun he tells them that they cant. Isnt there some kind of regulation out there that says they have show them?? I think this guy just has it out for the Military. I see him on the road just about everyday with a car that has DOD decals on it pulled over. I now only drive like 50 in a 55 because I dont want to get pulled over by this asshole. Man this sucks...

Okay. Im done I just wanted to bitch a little.

Tell all your friends to go to court and fight it.You might even call the local DA.Sounds like one of those bad apples if al your info is correct.As for the other post and making up for people that got off at some point,that is BS.Maybe we should put you in jail for murder because OJ got off;)

My father in law from S.C. got pulled over and ticketed for speeding in VA a couple of years ago. He was going barely 10 mph over the limit. They forced him to go back to VA for the court date... Man... I'm not sure I would want to live there... [:/]

Every one of them is choosing to fight it and all have already filed grieviances aginst him, which is why Im shocked hes still on the road. Ill Pass along the info about the DA. I know they have lawyers but one of their lawyers just said they should pay the fine. :S

Yeah I dont think I would want to live here on more than a temporary status....

Then that's a lawyer who should be reported to the state bar, and to whoever else has ethical jurisdiction over lawyers' professional behavior.

Let's remember that although American liberty has deep roots in Virginia, at the same time it is a state that has criminalized radar detectors. Essentially, the state may snoop on you, but you are not allowed to find out for yourself if you're being snooped on. >:(

And this abuse-of-power case with this asshole cop...! >:(

Fight that fucker and make him work at the goddamned MALL for the rest of his life!

I'd take it to court or contact the J.P. for that area. I had a similar situation, years ago. I got 3-speeding tickets in 10-days from the same State trooper, in the same stretch of highway. The worse ticket was for 4-miles over the posted speed. I called the J.P for that area and he told me to dis-regard them that he would be talking to the officer involved. Seems as though, I wasn't the only trucker he was doing that to. They do not have to 'retain' the reading on the radar unit. I'd do some serious question asking.

In most places, by law, the cop must show you the radar gun if you ask for it.
That alone will be grounds for dismissal.
However becareful how you talk. If you say "He wrote me a ticket for 30 over and I was doing 5 over" you have made an admission of guilt and you may get a lesser fine, but still better than the one issued.

Not a law. Common misconception. It is the officer's judgement. It is a safety issue. Letting somebody get out of their vehicle on a busy roadway to look at a radar could be a fatal and costly mistake to the officer/municipality. Aside from this, it is a lot more safe to keep the individual in a confined place (the vehicle) for officer safety. All it takes is one crazy person to go for the officer's gun because he is angry about the citation and somebody will get killed. Don't only look at it from the civilian's point of view. Look at it from a safety point of view for everybody involved. Police have a split second to make a decision. The critics have days, months, and years to make the same decision the officer only had a split decsion to make. If you feel you were wronged, take it to court. It is easier to get it thrown out or reduced on a prima facie law than to try to get a cop fired because he was looking out for your own safety and his own safety. I agree that there are bad cops out there with attitudes, but that doesn't mean they are all bad. All cops are bad until you dial 911.

actually you have the right to face your accuser, the radar gun in this case as he gave you a ticket for a specific speed. if he had given you 'unsafe speed for conditions' it is totally a judgment and you have no recourse, but by citing a specific speed at a specific time he is required to produce evidence of this observation, and evidence that they instrument in question was capable of making the observation (aka properly calibrated) The cop will be required to bring this evidence and evidence of your speed (nearly all commercial variants i am familiar with will have print outs) with him if you challenge it in court. Failure to do so generally results in immediate dismissal.

5mph is less than the tolerance for any commercial radar gun and can easily be fought. I've had some 5 tickets thrown out or reduced due to improper use of a radar gun by a cops who thought they could 'bully' me and extort an improper tax.. most people simply pay it as generally it isnt worth the time and energy to fight.. but if facts are as the original poster claimed he should get a lawyer and fight.

Exactly... and most cops any worth their salt will bring in proof of the properly calibrated radar. But no judge i've ever known will throw out the charge simply because the officer wouldn't endanger the accused or himself by letting the accuser out of the vehicle into a possibly hazardous situation. With any luck, the cop won't show to court, or the defense counsel will be primed on the prima facie laws of the municipality that the offense allegedly occurred in. All it takes is one person to get plowed on a freeway by another motorist and then the cops will be persecuted for having let the person out of the vehicle in the first place.....

unconsciously ? or maybe they where bullied out on high scholl... go figure :P

Well, on principle, they should not be lying to issue you a ticket for a speed you were not doing just to force you to say, "I wasn't doing XX, I was just doing X!" That's back-handed, and it's bullshit, and authority figures should not be allowed to get away with it.

Honestly, though, the times I've gotten speeding tickets, I was not given a citation for more than I figure I was going. I think getting a speeding ticket for a speed that is still safe even though over the bullshit arbitrary "limit" is just crap, to start with. But at least I wasn't really abused by the cop(s).

not me, and even though i repied to unlucky this is to everyone....... you guys know you are stereotyping when you say you hate cops, i've met some damn cool as cops, hell there is a cop at my dz that told me he hasn't given out a ticket to anyone in over a year (but he did throw a cupof coffee at a truck cuz it almost hit him) how about we try to say inthe future, "this one cop, he was a dick", instead of just the general "cops suck".........sort of meakes me feel like peopel are puting down the dude at my dz and my uncle who happen to be cops.......


ps.... the above was just a rant of my own and not directed at anyone, and i'm not overly pissed about anything,just wanted my opinion to be out thre..........

p.p.s. to the original poster........... dud take classes on base/post/station/ whatever it's called, then no worries about out of state plates or tickets along this area of road......

I used to work in law enforcement, but I wasn't a dick! Keep in mind different states have different law's and procedures. Even some cities have different laws. Alot of smaller cities actually pay for the majority of their budget with speeding ticket fines. And military would be considered easy prey because they don't want to get in trouble so they would pay the fine and make it go away. Research the laws and criminal procedures for Virginia and that city first before you try to make the case.

On a side note please don't tell my new DZ I used to be a cop. At my last DZ they wouldn't talk to me for six months after they found out. They spent most of the time keeping me away from where they kept their weed!:P
