LaDonna 0 #1 April 18, 2005 My boss didn't approve of me going to doctor once a week so she told me today that she had to let me go. That she has a business to run and 8 weeks of me being gone on Friday afternoon was not going to work for her. With the fractured spine I can't even go skydiving. Snowwhite 0 #13 April 19, 2005 QuoteCall an attorney, perhaps you can sue them under the ADA. YUP! you can't get rid of someone, just cuz they are under a docs care. If that's the reason they gave, if it's on your termination papers, go get your job back. But then they will find some other reason. You need to request your file immediately. I actually have gotten 4 job offers in the last hour from my bosses clients. So I will just have to decide how long I want to be off work before I accept one of them or none of them. dgm458 0 #16 April 19, 2005 I'm not advocating filing any lawsuits, but something to think about is do you qualify for protection under the Family Medical Leave Act? Certain business don't fall under the FMLA and the employee must have worked at their business for one calendar year and must have worked 1250 hours within the last calendar year. If you qualify, a complaint to the Department of Labor may be in order. You boss can't even have a discussion about your missing work for doctor's appointments if you qualify for protection or you can sue him/her individually along with the business. Again, I'm not advocating a lawsuit, just stating fact. dgm-------------------------------------------------- Failure to prepare is preparing to fail
