akarunway 1 #1 September 3, 2004 I moved out of a apt. in So Cal. last month because of drug dealing, gunfire all the time, one guy killed. and they wanted to jack up my rent 20 percent. I lived there for TWO years and put up w/ all BS best I could. I just got a letter at my new place. They want a couple hundred dollars to paint the walls and clean the carpets or they are going to put a collection agency on me. LOL. Isn't that normal wear and tear? Fuckin bastards. They will give the welfareites free rent till they have to evict the none paying bastards. RANT OVERI hold it true, whate'er befall; I feel it, when I sorrow most; 'Tis better to have loved and lost Than never to have loved at all.
jazzjumper 0 #2 September 3, 2004 Did you put a deposit down? What does your lease say? You can always file a claim in court and it's up to them to prove the condition of the apartment when you left. The worse that can happen is you pay the money, but you inconvienence them. I'm all about training management companies. No matter how good she looks, someone, somewhere is sick of her shit! rickdaddy 0 #3 September 3, 2004 Stress the natural wear & tear to the landlord & stess the fact. Most landlords try to strongarm the tenants into paying or threaten credit reports. Don't get into screaming match but state your case clearly. If nothing avails pay & move on with life.
Zee 0 #4 September 3, 2004 I lived in an apartment in Austin,TX once and when I moved out the bastards sent me a bill for $700 which they said was for cleaning and repair. Since I knew there was no damage to the apartment, I just sent them a registered letter stating that they needed to give me an itemized bill listing all the damage and the cost to repair each item - I never heard from them again. I think I'm just gonna buy a house..... Action©Sports

Nightingale 0 #6 September 3, 2004 Get a lawyer. I used to lease in california. Companies will go after you for this, because "normal wear and tear" is ambiguous.

Cleaning the carpets when you leave is a typical requirement unless the landlord intends to replace them for the next tennant. If you don't do it yourself, then they'll pay someone else to do it and bill your deposit. I don't know about repainting however. That's akin to carpet replacement, which is a wear and tear item. Did you clean the walls before vacating? Patch any holes you made?

Frenchy68 0 #10 September 4, 2004 Carpet: depends on how bad (or good) of a shape you left it. Painting: if you painted your walls a different color than the original one, they can probably nail you for it, unless you got their consent. If you haven't touched it, I believe that local real estate laws require the landlord re-paints (at the new tenant's request) the apartment. But don't take it from me. A local lawyer will probably advise you of your status for free.
