a really bad paper card thats printed on with a desk jet. Considering the bugets for eveything else, it really is pathetic...

I think i may have got that plastic wallet. pointless.

I'm thinknig about stealing his card. Its waaaay to flash, printed picture of him on it, all his dive details etc. PADI know what they're doing

the reason we still get negligence claims despite a signed written exam is two fold.

1. People are gready and dumb, and lawyers are whuffos (mostly). A claim doesnt have to have any merit to be brought and cost the BPA money to tell them to fuck off. There may be absolutely no hope of the claimant winning, but it still costs the BPA money to say so.

2. Understanding the risks does not prevent a claim in neg. Imagine a SL instructor forgot to hook up the SL. Just cos you appreciated the risk of skydiving doesnt make it excusable for the instructor not to hook you up. (ignore the possability that you should check just for the sake of the example).

The reason we get trivial claims despite waivers is because the BPA probably just refers them to the insurance company. The insurance company then work out how much they expect it to cost if they fight it and lose. If the claim is for less, they pay up. They won't even take the chance. The lawyers know this and take advantage of it. Net result, insurance premiums go ballistic and everyone loses out.

Every asshole who goes around with "in case of emergency, please call Claims Direct" on his lips should be tied to his lawyers and thrown down a mine shaft.

By the way, I'm actually dealing with a claim against the BPA insurance at the moment.

[dons fire retardant suit]

Let me explain first before you shout at me. A member of a demo team undershoots and hits a daft bint stood in the crowd.

A colleague is working for the claimant through her insurance policy. She knows Im a skydiver so asks me to write an opinon. I tell here the claimant has no hope in hell of ever winning (true - various reasons) so she should drop the claim.

I think they are currently in the process of dropping the claim.

[/takes off fire retardant suit]

So you see - I personally have saved the BPA money by preventing a law suit against them.

One thing I thought sucked was not being able to gain temp membership if resident in this country. I no longer skydive but when I had a friend visit me I wanted to dust off my old freeflying skills and make some jumps. I filled in the Temp membership form as it says clearly on top ".......or people wishing to join the BPA temporarily" – I filled it in, the manifest guy agreed with my reasoning on why I was taking out a temp membership and I had 1 month worth of UK skydiving.

A month later I received a letter saying what I had done was wrong and if I wanted to skydive in this country again I must pay full membership (including FULL payment for the remaining 8 months) – I wrote back explaining why I thought I was able to and also the fact that (and I lied here) I skydive abroad and only want to skydive in the UK a couple months a year.

I received a snotty letter back saying that in no way was I allowed to “cherry pick” my membership terms and if I don’t pay full membership I cant jump…………………..

To me I think this unfair………….. Maybe I am being unfair…………………..

Just wondered what you BPA members think – and whether this “cherry picking” should be allowed………………….

As for the BPA – I aint that fussed about skydiving anymore so no great loss to me…………………………. They just loose my money!!

Thats not how it works here. Insurance companies never just pay up without looking into whether or not the can escape liability. With the insurance firms I work for this almost always involves farming it out to a firm of solicitors who know what they are doing (some do still do it in house).

Its paying the solicitors fees for deciding if the claim should be defended or not that costs them money. Overal its still cheaper than just paying up.

Yes you still get a swanky plastic wallet, which is about 1.5 times the size of the bit of card inside it. Classy. I took mine out and laminated it so it fits in my wallet because I was bored at work (no! surely not) one day.

1. OK - I understand what you're saying on this - even if someone has a truly pointless case, they can still bring it and it costs us legal fees regardless. And I guess in most cases, paying a lawyer to tell them to f*ck off is cheaper than paying them damages. Do we know if the BPA has a policy on this? If not they should have!

2. I imagine such instances are very rare (I may be wrong!).

The problem seems to me to be people who are only ever going to do one jump. They bruise/sprain an ankle on landing and then decide to try to make some money fast by going to a "no win no fee" lawyer... [:/][:/][:/]>:(

Hmmm... there are lots of arguments against increasing temp membership (i.e. student parachutist insurance) but since they are the ones making the claims - surely they should pay?! If they're willing to pay £200 for a RAPS course, surely they'd pay £220?

Hey Macca ?if you want a decent membership card that isn’t made of paper join the USPA! You get twice as many mags, insurance cover in the US and (the best bit!) it costs half the amount of BPA membership! :P:P

Go figure?:D
