I had a little time to waste this week-end and got creative....

Comments are welcome. If you work for Go Fast, I apologize and feel free to use the idea....

doesn't there have to be a profit motive in a trademark case?

I dunno, I'm not a lawyer. And I didn't stay at a Holiday Inn Express last night either.

Wouldn't you be a bit upset if someone used a logo that you put a lot of time, money and work into without asking permission, even if there was no profit motive?

Oh and don't get me wrong... I love the wording on the shirt! B|

I actually did that... Cuz Skybytch scared me!
I told them it was a one-off for my kid. I doubt they'll make a big deal about it. At worse, I'll send them whatever price they get for a t-shirt!

now I'm all nervous... I was meant in good fun!!!!

I doubt they'll be too upset since you did contact them about it... Troy's a jumper too after all.

If they do decide to produce it I'll be ordering some for the shop; we need more cool kid's stuff and I think that one would sell good! B|

That's fantastic! Of course I'd have to mark through the "Dad" stuff and put "Mom and Dad" or some such ;) My kids have skydiving t-shirts AND socks...they are worn out...I'd certainly get them one!

If they need to go after you for that....they have bigger problems than t-shirt sales.[:/]
I wouldn't worry too much.
I'm not usually into the whole 3-way thing, but you got me a little excited with that. - Skymama

I'd buy three even if it wasn't Go Fast that runs with the idea. There's other t-shirt printers out there, but A Go Fast logo would look the coolest.
Somebody around here has got to know Tony persoanlly enough to make sure he sees this thread.

Huh?!? What cloud?!? Oh that!!! That's just Industrial Haze

Well, don't get too nervous about it.

What constitutes trademark infringement is - If a party owns the rights to a particular trademark, that party can sue subsequent parties for trademark infringement. 15 U.S.C. §§ 1114, 1125. The standard is "likelihood of confusion." To be more specific, the use of a trademark in connection with the sale of a good constitutes infringement if it is likely to cause consumer confusion as to the source of those goods or as to the sponsorship or approval of such goods. In deciding whether consumers are likely to be confused, the courts will typically look to a number of factors, including: (1) the strength of the mark; (2) the proximity of the goods; (3) the similarity of the marks; (4) evidence of actual confusion; (5) the similarity of marketing channels used; (6) the degree of caution exercised by the typical purchaser; (7) the defendant's intent. (Source: http://cyber.law.harvard.edu/metaschool/fisher/domain/tm.htm#second)

You did the right thing by sending it to them for consideration and I doubt anything will happen. Its not against the law to draft a "pitch" to an organization using their logo as long as your intent wasn't to deceive anyone into purchasing your product as theirs.

I would venture to say that they will respond with a thank you and/or acceptance or rejection of your idea.

It is a cool shirt and would probably sell well. If they adopt the idea, just tell them you're not looking for any remuneration. They'll probably send you some Go Fast "stuff."
