EricaH 0 #32 June 4, 2003 Serious question... Is it TRULY legal to drink an alcoholic beverage while driving in Texas? Or is it legal for the passengers to drink? I've visited a few times & had the remainder of the last Margarita put into togo cups. But now I'm moving there & this is valuable information!! There is no can't. Only lack of knowledge or fear. Only you can fix your fear. PMS #227 (just like the TV show)
txblondie 0 #33 June 4, 2003 I believe it; I think it's a prerequisite for a Texas cop to have a burning iron rod stuck up his/her ass... I've never run into a nice cop in TX, and if there are any cops reading this who happen to be nice, then I just haven't run into you yet! ***************************************** Blondes do have more fun! AggieDave 6 #34 June 4, 2003 I've been pulled over by some cool cops before. Strangely enough, they were State Troopers, not locals. Never been pulled over by a Sheriff (knocks on wood). Then again, where I grew up, to get pulled over by a Sheriff, you'd have to be doing 90 in a school zone, high on crack, tossing beer bottles out of the car while firing an uzi at a church.--"When I die, may I be surrounded by scattered chrome and burning gasoline." I don't think we have an open container law, but the driver does have to have a passenger to hand the beer to. Nope, I haven't looked it up, but I remember all the little can covers that came out when that law was passed. It went on further and he didnt like it.....needless to say i got a ticket for that one."Professor of Pimpology"~~~Bolas

I can't beleive he didn't do a sobriety test after that comment. ___________________________________________ meow I get a Mike hug! I get a Mike hug! EricaH 0 #39 June 4, 2003 Good info to have - I kinda thought that would be the actual rule... that the "passenger" is drinking. It's still pretty cool. I know a bunch of people here let their passengers drink, I hate to say no when I'm driving... but really don't need the ticket. There is no can't. Only lack of knowledge or fear. AggieDave 6 #40 June 4, 2003 We do have an open conatiner law. Came into effect 2 years ago, which sucks.--"When I die, may I be surrounded by scattered chrome and burning gasoline."
wmw999 2,444 #41 June 4, 2003 No, it really doesn't suck to have an open container law. Unless it's the kind that means you can't carry a bottle of booze in the back if you have a station wagon. Drunk driving is too expensive to make easy. Really. Wendy W.There is nothing more dangerous than breaking a basic safety rule and getting away with it. EricaH 0 #42 June 4, 2003 I do not condone drunk driving at all!!! It is dangerous to everyone. But I am curious if a passenger can have a drink. Also, in IL you can't get a drink "togo" from a restaurant; but they were more than willing to do it in TX... I'm wondering where the line of the law is. It'd prob be best to actully read the book on this one though. There is no can't. Only lack of knowledge or fear. Only you can fix your fear. annieoakley 0 #44 June 4, 2003 My best cop story happened a couple of years ago. Some friends and I were hungry at 1 am and decided to hit the drive through. We got pulled over doing 50 in a 35, and the cop asked where we were headed and why we were speeding. My friend who was driving said we were headed for Taco Bell. The cop ended up letting us off with a warning, stating, "I know what its like to need to run for the border!" wmw999 2,444 #47 June 4, 2003 My brother was driving in W. Texas (where roads are long, straight, and lonely) from a University of Texas game of some type late one night with 5 friends. All friends were plastered, my brother was not. No open container law in Texas at the time. Going about 95 mph, he sees a blip on the radar detector and slows down. Got pulled over, and the officer comes up: "Son, do you know how fast you were driving?" "No sir, officer, I'm afraid I was watching the road" looks in car, sees friends and smells brewery. "Son, have you been drinking?" "No sir, officer. As you can see, my friends have, but I haven't" officer is quiet a minute, and continues "Well, son, you were doing 95 when I first clocked you. At the second tick of the radar, you were doing 70, and on the third you were doing 55. There's no way you could have done that if you weren't absolutely stone cold sober. I'm going to let you go, because I went to UT myself, and can appreciate the joy at winning a game." "Thank you, officer" (breathing a huge sigh of relief). "However, son, about one mile down the road is the territory of another trooper. He's an Aggie. I'd suggest slowing down" My brother said he went 55 for a LONG time after that. txblondie 0 #48 June 4, 2003 I've been pulled over by a state trooper who was based out of West, TX. Talk about good ol' boys! He was in the office with the judge discussing the case before I got there, probably talking about ways to screw me out of more money! But you're right, in social circumstances, I've met a few cool cops. Just not been stopped by them. Lucky for me I don't own an uzi or keep my crack in the car! ***************************************** Blondes do have more fun!
ERICCONNELLY 0 #49 June 4, 2003 I can say there are some good State Troopers in TX. Got pulled over once giong from Houston to San Antonio, was in a hurry to get out of Houston (go figure). I was doing something like 85 in a rental car, cop that pulled me over gave me a WARNING and said "Try to slow it down please" He must have already met his quota!!!
