kansasskydiver 0 #1 May 8, 2003 I just had a co-worker come up to me and ask about skydiving. A lot of people have started to notice, after a year of my presence, packing at work, pictures etc that I'm a skydiver and have become interested, but this guy was just stupid. He started asking questions about tandems and skydiving, where to skydive etc. I gave him our clubs business card and showed him our website. Explained to him that we jump every weekend and that I was the president. Educated him about the club and who we were etc. Then he starts going off about safety. I explained to him that the media and movies make it worse than anything else and he begins to threaten me saying if anything happens he's going to sue me and the club and hold me personally responsible. I replied back to him and said that's why we require a waiver. "Oh that wouldn't matter, I'll still sue." What the hell is up with whuffo's trying to show how big and bad their balls are by pointing fingers and saying their going to sue, instead of getting up in the air with us and prove something!!! jmpnkramer 0 #12 May 8, 2003 Hey Chris: You are always going to have people like that. I have seen people try to sue. The waiver provided it was written by an attorney is definitely good enough. On the other hand I would turn the business away because it is not worth the hassle. I have a Tandem rating and unfortunately had to take similiar people up who act like that. On our waiver we have a place for the person to buy their rights back at $300 a jump. In my experience though more often than not it is the student who does not listen to their instructor who gets hurt. I have only sprained one persons ankle and that was because they did not listen to me. Of course when I went through the course I was taught that if it comes down to it and the student does not listen break them first. It is the livlihood of the instructor not the student. Anyway, I would just say tell that guy that maybe skydiving is not for him. Of course you need to do it in good political fashion. You can die. Even tandems die. Tell him that he should not do it. I mention skydiving, but I never try to talk anyone into it. Either they really, really want to or they really don't. AggieDave 6 #23 May 8, 2003 Even if the lawsuit is unwinable, a lawsuit will drain money from you in legal fees, etc. He would have to counter-sue to get his money back, which means more money spent, and even if he wins, the person has laws protecting him (bankruptcy, etc) from having to pay.
