Faber 0 #26 January 3, 2003 Quote Reports also indicate that McDonald's consistently keeps its coffee at 185 degrees, still approximately 20 degrees hotter than at other restaurants. So if coffe should be between 190-200degees,then it realy are all the other resurants that should get sued for serwing cold coffe or what?Or did i miss somthing?(i still espect tat were talking farenheit, whil wather boil at 100degree C). ernokaikkonen 0 #27 January 3, 2003 >Sure McDonalds knew that people could get burned from their coffee. I guess that's the point of the case. My point was just that many people seem to think the case went along the lines of "Oops, I spilled coffee, I'm pissed, gimme millions". >If one don't know that coffee is hot, I seriously doubt one can >read the warning label. Yeah, but now they can't sue you.... Unless they're illiterate mexicans?
newshooter12 0 #28 January 3, 2003 The cases really aren't realated. That was intentional. I was just trying to establish the fact that, at least in my state, people are law suit happy and that has a tendoncy to keep others from sticking their necks out to help. C? IronMike 0 #29 January 3, 2003 No matter the outcome, getting sued will ruin the average Joe...My Godfather lost everything defending himself against Indecency With a Child charges that were, and proven, to be completely fabricated by a woman in his church that had done it 3 times in the past to other people. Even though his name was cleared, the defense cost him several hundred thousand dollars, wrecked his marriage and made him into a recluse. It should be a major felony to file a frivelous lawsuit. Alternatively, the moral of the story is not to go to church. Seriously, crappy outcome. Sorry it happened.
PLFXpert 0 #31 January 3, 2003 Quote Don't forget the McDonalds' "HOT COFFEE" lawsuit, too... OK...While I'm sure I'm alone in this and don't want to start an argument...I see the validity for this case. While I think it's ABSURD the people sueing Mickey D's b/c they're getting fat (ridiculous!), I do see the point in the lawsuit over the hot coffee. If the coffee was so hot, that when it spilled on the woman, it caused 3rd degree burns, that is TOO HOT and IS McDonald's fault, in my opinion. It's not McDonald's fault that the woman spilled in the first place but accidents happen and the coffee was way too hot. Try spilling any other cup of coffee on you, and while you may say, "Ouch" it will not cause a third degree burn. There, I said it!Paint me in a corner, but my color comes back. freeflyz 0 #32 January 3, 2003 For people that are saying that they would not stop because you would be too scared to get sued! Is money more important than a human life? But for me i would stop like i have always done before, if they want to sue me go for it!

Your point might be valid except for the fact that if she wasn't driving her car when she decided to first take a sip, she may have noticed how hot it was and also may not have spilled it. Who's never burned their lip on a cop of coffee? If you're too dumb to test its temperature before you try to drink it while driving down the road, then you deserve 3rd degree burns. Coffe is HOT,in my oppinion(im not an doc)you can burn your bare skin on coffe, but not a 3 degree burn, unles you hold the skin under the hot coffe, and dont use cold wather on it afther wards..But again who would like to do somthing like that?migth thouse who want mony.. I sure would be sad if my coffe should be "cold"becours someone are trying to make a buck or two Stay safe Stefan Faber

craddock 0 #43 January 4, 2003 [ QuoteIn many places here in the US there is what we call the Guardian Angel cluase, which means that if passerby helps you in life threatening situations, like CPR and lets say that they accidentally break your ribs, you can't sue them. This is known as the Good Samaritin Act. Most stated have it in some form. Check your state laws. In some states it is punishable offense if a qualified person does not help out. This law is geared toward protecting the qualified health care provider when rendering aid. That spot isn't bad at all, the winds were strong and that was the issue! It was just on the downwind side.
