Good news bad news.

Well....I just got off the phone with my attorney.

Good News: I may actually get a trial date tomorrow. She feels confident that the judge will give me custody when that trial occurs.

Bad news: It'll be about year.....[:/]


Hmmm...does 5 FUCKING years seem a little long to get a modification of custody hearing to anyone else? Does 5 Fucking years seem a little long for the State of Tennessee to leave a child in the hands of a convicted felon? Convicted on Class D Felony aggravated Child abuse at that?


I really don't have much to say other than WTFO??? Who else thinks I should sue every agency and state entity that contibuted to this mess? [:/] I guess on the bright side I can see the smallest shimmer of light at the end of the tunnel. I'm sure someone will slam the door shut momentarily.

man that sucks five years is a long time. keep your hops up sometimes it has to get worse before it can get better and it seems as if it is starting to get better so looks like the worst is behind you...

Tell your attorney "I appreciate you efforts, but they just aren't getting
me anywhere and I may be pursuing other options. A year is too late.
If you can't get a court date in 3 months, I am going to get another
attorney. I'll have a year to do it." Say it politely. Light a fire under them.
After a year of jerking around, I told my attorney he had two weeks to
get it done or I was gone. No more attorney fees. Out of state.
That Friday, "They want to meet and settle next Friday."
I doesn't sound like it can get any worse. Get it done so you can move on.

It is a long time, and it is a f*cked up deal, Clay.

I figure you're just venting steam about suing, but resist. An important element of your background investigation is whether you are a party to any lawsuits. Get your new gig, get off probation and then let loose if you're still pissed.

Actually....I have already fired one a few months ago and I'm on my second one for THIS case. She told me that I could go to court by January if I wanted to file in Circuit Court instead of Chancellory. The only bad thing about that is....who knows what judge I will get. I know this judge...so does my attorney. The judge also knows my ex-wife and doesn't like her much. ;) This judge has already heard mountains of the crap my ex has put me through and ruled STEARNLY in my favor the last time I was in her court room. I would rather wait one more year and be safe than try to get it done quickly and possibly lose my advantages. I only get one chance to do this right. I have waited this long...I don't want to get in a rush and screw it up now.

Clay, Bill (happythoughts) is completely right. Tell the bitch (I mean lawyer) that she has a limited lifespan with you if she don't get results. Over last weekend I spoke with Terrasino, who is a lawyer. Quote: "In a divorce the lawyers are the winners. They take your money and then go together to have a laugh and a beer." Don't let your lawyer bitch have that beer. You are the customer: DEMAND performance. If not, Get the Fuck Out. Streets are lined with lawyers.

They were done with that investigation a couple months ago. Not a worry. Just waiting on the "adjudication" process as far as I know. However the hell long that takes. [:/]

Hang in there man. I just went thru the same crap and it all turned out good ('cept I didn't have to wait a year, only a couple months). Your kid will be with you before you know it. The good thing is, even if it takes time before a trial, if the ex screws up, she'll really get hammered at the trial. All the best man!

Dang, a year seems a bit over the top, but then again, I don't know much about the American legal system. I hope you can get it sorted sooner than that, the wee man will grow a lot in that year. How about you suggest delaying paying the lazy cow for a year.....see if that speeds things up.

Thanks guys!!! I'm in a bit better mood so far today. Except the fact that I brought everything I needed to go to the DZ straight from work. Well...not including some paperwork that I HAVE to have taken care of this weekend. So....now I get to drive an hour or more back home in the wrong direction to get it. [:/] Damn I'm a dumbass sometimes. :D Oh well...it's Friday...with perfect blue skies. I have a 12 pack of Rolling Rock in the cooler. Jump money in my pocket. Life is good....B|

Actually in Tennessee they have a law that is just a couple years old now. It doesn't specify any certain amount of time but it does require that anyone who wants to get divorced must also file a "Parenting Plan" with the dissolution of marriage paperwork. It's a pretty detailed plan and covers all the stuff like holidays, weekends, medical coverage, etc. Before (Like when I got divorced) all that stuff was just blowing in the wind.
