hottamaly 1 #1 March 22, 2002 Do you think these people raising these pit bulls and the like, for fighting and to be aggressive (other than for home protection) will get the message sent by the jurors in the dog mauling case? What do you guys think? Should the owners be liable to the extent of going to jail for their animals killing someone?I personally think the jurors did the right thing. Teach these jerks a lesson.Nothin else going on today so thought I'd start a new post.....SKYDIVING GAVE ME A REASON TO LIVE....
AggieDave 6 #2 March 22, 2002 Man another damn skydiver died today...when will they get the message that they're stupid for hurting their friends and family by jumping out of those planes. Planes were meant to fly and land in, not jump out of...(me playing a bit of a devil's advocate..."ahhhhoo...the little guy hasn't done anything yet and you know its going to be good..." jfields 0 #4 March 22, 2002 I agree with you, hottamaly. "Normal" pets don't do that sort of thing. And by training and coercing an animal to react that way, I'd say the owner is responsible for the animal's actions. Evidently, the jury agreed. I'm glad.Dave, to put it blunty, your analogy sucks. Try this one: It is like leaving an armed Claymore in the hallway. Whether by setting the mine or by training a dog, the result was the same. Something was made to be lethal and then handled carelessly.(Devil's advocacy is fine, but get it to make sense. Justin

jfields 0 #6 March 22, 2002 QuoteI don't like the idea of aggressive dogs being raised that way for no reasonMe either. That said, if the dog raises no problems and is kept 100% responsibly, nobody would probably ever know. But if you choose to take that risk and fail, you deserve the consequences as if you had personally done whatever your dog ended up doing.Dave, I know you were just starting conversation. I was just giving you shit. Justin
Muenkel 0 #7 March 22, 2002 QuoteDo you think these people raising these pit bulls and the like, for fighting and to be aggressive (other than for home protection) will get the message sent by the jurors in the dog mauling case?Unfortunately, no. We have convicted so many murderers and yet we still have murders being committed. I don't like to sound like a pessimist, but there seems to be a lot more crazy f@##$%d up people in the news these days.Skydivers...they're just plain cool!Chris

lummy 4 #9 March 22, 2002 This is local for me and the consensus was that the two were not believable and showed absolutely no remorse. The jury didn't believe them and subsequently found them guilty on all charges. There was an article about a week ago where the DA handling the case was interviewed. He mentioned that the two would never have been charged if it weren't for their obvious lack of remorse for the incidentShort answer. bbarnhouse 0 #11 March 22, 2002 Agreed, just as parents need to be responsible for the actions of their children, it should be the same with their pets. If these two had shown the least bit of remorse, the outcome may have been different. Personally, I think they allowed their egos to get in the way of what was right which would have been apologizing and taking responsibility for the actions of their dogs and the subsequent death. It only takes a little pixie dust...... lummy 4 #12 March 22, 2002 I agree with you but that wasn't the question. LittleJumper 0 #19 March 23, 2002 My opinion...I think that she should not have been found guilty for 2nd degree murder. Involvuntary manslaughter perhaps...but 2nd degree??? Look what this case will do to future dog owners and/or dog caretakers. If you own a rotweiller...2nd degree murder...if you own a pit bull...2nd degree murder, and the list goes on. Wont matter how & if you were able to maintain the beast...it's the owner's fault...100%...Poodles??? Yeah leat's add them to the list too!I also didn't like how the prosecution was allowed to interrupt defenses closing and when defense interrupted...she got the hammer!!My opinionWhat you "think" you cannot do ...you CAN if you "think" about it
LittleJumper 0 #20 March 23, 2002 Not to be a post whore...but let's face it...congress & the legislature need to impose stricter laws for people who own potentially "dangerous" animals. What you "think" you cannot do ...you CAN if you "think" about it
kmcguffee 0 #21 March 23, 2002 I think it was right because they knew the dogs were dangerous and didn't do anything about it. They were actively negligent with two very dangerous animals. Now if my sweet calm labrador retriever were to suddenly lash out and attack someone and kill them I don't think there is any negligence in that. I think it should still be pursued on a case by case basis. All animals have minds of their own and cannot be completely controlled by their owners at all times. Just my opinion. BTW....I don't actually own a dog.
LittleJumper 0 #22 March 23, 2002 Apparently you missed the point. What basically happened is that "no matter what type of dog you have", if it kills someone, you WILL be charged with murder. I absolutely disagree with that result. Granted, yes they were negligent, but not to the point of 2nd degree murderWhat you "think" you cannot do ...you CAN if you "think" about it
kmcguffee 0 #23 March 23, 2002 I wasn't disagreeing with you or commenting on your post, just stating my opinion. My opinion is that the verdict was correct in THIS SITUATION. All others must be decided on a case by case situation. We shouldn't make a law that blanketly says, "if any animal kills a person their owners will be charged with murder". You know, this reminds me of how the Nazis' used to handle thier pets. Doooooooh Is that the end of this thread?
LittleJumper 0 #24 March 23, 2002 Again...not to be a post whore...but negligence is not even an element in 2nd degree murder. I dont have my Black's dictionary handy...but if my memory serves me correct...2nd degree murder is the "wanton disregard for the life of others...." seems there is more to it...but negligence does not play a part. I practice civil ligitation...not criminal...so forgive me for my forgetfullness. What you "think" you cannot do ...you CAN if you "think" about it
