Jabeln79 0 #1 September 11, 2001 Well i seem to have gotten into a small problem with another DZ.com member. Heres what happend. About a month ago i was looking through the DZ.com classifieds to find a good deal on some used gear. well i found this jump suit that would be perfect for me , right size good shape and a good price. so i call the guy selling and talk to him about it and he seems like a real nice guy, we share a couple sky dive stories and everything and i decide to go ahead and buy the suit.. So i go and buy a money order and mail it out that same day. A couple days later i get a call from his wife saying that they recieved the money order but her purse was stolen with the money order in it. Now heres my mistake i lost the reciept so i couldnt stop payment in the money order, now they wont send the suit and im out over $100. A month later and still no work from the people aside from on e email saying they wont send the suit until i send another check. So do you think that since i lost the reciept i should just accept my lost or do you think that the guy i bought this from is in the wrong because after all i did pay for the suit.Or do you think that i just fell for a stupid scam and completely lost out. skyhawk 2 #2 September 11, 2001 um i dont know whatr to say. If you contact they banck they should be able to cancel it or atleast tell u if it has been cashed. This is a triky situation. They arent going to give you the jumnpsuit for free but by the same token you shouldnt be left in the open. Mayby make an aggrement say cause they lost it you will give them $50 for it instead. nimbus 0 #4 September 11, 2001 I think if they've received the cheque, you've completed the part of the transaction you're responsible for so they should send the suit! Wouldn't the post office (or wherever you get money orders from) keep a record to register all money orders? They could maybe trace & cancel it... and repay you the money if there's a police report signed by the people saying they received the cheque but it was stolen, or directly pay the people. Do you know if it's been cashed? Someone would need ID to cash it, and if the someone wasn't the people you sent it to, they'd have a hard time doing that.good luck!Larissa Quote Share this post Link to post Share on other sites
airgord 1 #5 September 11, 2001 The wife said that her purse WITH your check inside was stolen. That confirms that they recieved your payment. The theft of her purse was not your fault. They owe you the suit or your money back, their tough luck.Do check with whatever institution that you made the purchase of the money order from, they can tell you if the check was cashed. Good luck. NewGuy 0 #6 September 11, 2001 As far as I understand the law, they received your money; money order, cheque, cash, whatever, it was received and they are legally bound to either return your money or send the suit. If this is correct, getting your $$ back is another matter...I find it astonishing that any reputable person would even attempt to try to pin that one back on you - they lost the money. Once it is in their hands you are no longer responsible for it.Was the money order made out to the person? mouth 0 #7 September 11, 2001 One of you laywer types could help here but it seems to me they lost the money. She should have declared it to the police when she reported the purse stolen. It is their responsibility. I don't know if I would go so far as have a lawyer contact them in writing but that may be an option. They owe you the suit, you paid for it, they recieved the check. Grogs 0 #12 September 11, 2001 Damn, I'm sorry to hear about this. I'm not a lawyer, but I would have to assume he's legally bound to send you the suit once he's received payment. The only question would be would the contract, i.e., e-mail traffic you guys exchanged, etc. hold up in court. Even if he's not though, I think any fair person would send you the merchandise. Not being personally involved, it's hard to say for sure, but I'd tend to believe the guy's trying to pull one over on you. If I had the money (which I don't), I'd get a lawyer and let him go after the guy. Of course you'll spend more money than the suit and your money order combined that way, but it would at least feel good. At the very least you can probably get a free consultation and have the lawyer confirm that you are indeed in the right. Throwing a couple of phrases like 'my lawyer told me...' into the conversation might be enough to convince the guy to quit screwing with you and send you the jumpsuit. That being said, you should have just came out and stated who it was that did it, so that others around him could get his side of the story. The way you have it stated, it's clearly the responsibility of the jumpsuit guy to send the thing to you; you paid and they received the money. dove 0 #15 September 11, 2001 They lost they check so it should be their loss, not yours. The suit is yours. They can recoup their loss by insurance if they so choose. The suit belongs to you. Sucks. I hate when this crap happens to good, innocent people. Especially skydivers. Whoever did that to you is not a real skydiver. Even if it is on the terms that you will continue to try to help them find the money order number, acquire a stop payment and reissue another one. But if that ends up impossible, you held up your end of the bargain, it isn't fair you are out the money and the jumpsuit because of their negligence.
