Guest #1 September 4, 2004 He's going to Federal "Pound-Me-In-the-Ass" Prison for at least 20 years... "One of most powerful pieces of evidence was a video, secretly recorded three days before his arrest, showing Anderson share information on troop strengths, tactics and methods of killing U.S. soldiers and destroying M1 Abrams tanks and other vehicles with undercover agents he believed were al-Qaida operatives. Anderson's arrest came just weeks before his unit, the 81st Armored Brigade, deployed for a yearlong assignment in Iraq. 'A nation can survive its fools, and even the ambitious, but it cannot survive treason from within,' " Maj. Melvin Jenks said, quoting philosopher Cicero, as he asked jurors for the maximum sentence. "Members, here is the traitor within the gates." Story in today's Seattle Times. mh .

ozthebum 0 #3 September 4, 2004 From what I understood he was convicted, but the military hasn't set the punnishment yet. "Jurors deliberated another 3 1/2 hours before recommending early Friday that Anderson be sentenced to life in prison with the possibility of parole and a dishonorable discharge. The post commander is expected to decide on a sentence in four to six months"--New York Times on the Web, from the "Early Bird"

The offense of attempting by overt acts to overthrow the government of the state to which the offender owes allegiance; or of betraying the state into the hands of a foreign power. Treason consists of two elements: adherence to the enemy, and rendering him aid and comfort. Cramer v. U. S., U.S.N.Y., 325 U.S. l, 65 S.Ct. 918, 9327 89 L.Ed. 1441. See 18 U.S.C.A. § 2381. jazzjumper 0 #7 September 4, 2004 Quote Tell me again why he didn't get the death sentance? Because he wasn't convicted of treason, but of... Quote ...for attempting to give aid and intelligence to the enemy. Why he wasn't charged with treason probably has a lot to do with amount of evidence required to get a conviction. The burdeon of proof is extreme under the UCMJ. The list of charges is here. He can get up to life, but it isn't considered a capital offense under the UCMJ. No matter how good she looks, someone, somewhere is sick of her shit!
Guest #8 September 5, 2004 Quote Tell me again why he didn't get the death sentance? John Walker was directly responsible for the lives of US servicemen lost in SE Asia as a result of all the intel he was handing the Russians, who in turn supplied it to the North Vietnamese. Oddly enough, he'll be a free man soon. I have a sneaking suspicion that he won't live very long on the outside. IIRC, he has been kept in the medical ward at Marion this whole time, because he wouldn't survive a day in the general population of a Federal Pound-Me-In-The-Ass Prison (maximum security, BTW, but not super max)...seems that criminals don't like traitors, whatever their stripe. Betrayal of one's comrades is the ultimate sin, right up there with molesting children in a hardened con's eyes. As for Ryan and Leavenworth - who knows? He's up for 20 big ones minimum, but time and circumstances change things and people. I'm guessing he'll do less than ten, and will disappear. If we're lucky, it'll be to the Middle East.
