minobu 0 #1 May 19, 2005 The bill is Defending America's Most Vulnerable: Safe Access to Drug Treatment and Child Protection Act of 2005 and it was proposed by Congressman Sensenbrenner if you want to read the whole thing http://thomas.loc.gov/cgi-bin/query/z?c109:H.R.1528: The really bad thing about the bill is the part about reporting. If you “witness” certain drug offenses taking place or “learn” that they took place you would have to report the offense to law enforcement within 24 hours and provide “full assistance” in the investigation, apprehension, and prosecution of the people involved. Failure to do so would be a crime punishable by a mandatory two year prison sentence. This guy put this foward last year and it didn't pass so I don't think it will pass this year but its just disturbing something like this could even be considered. So I was curious does being required to wear a wire while maybe visiting a relative bother anyone else? and how could ANY congressman vote for something like this? unformed 0 #2 May 19, 2005 QuoteFAILURE TO PROTECT CHILDREN FROM DRUG TRAFFICKING ACTIVITIES `SEC. 425. (a) It shall be unlawful for any person who witnesses or learns of a violation of sections 416(b)(2), 417, 418, 419, 420, 424, or 426 to fail to report the offense to law enforcement officials within 24 hours of witnessing or learning of the violation and thereafter provide full assistance in the investigation, apprehension, and prosecution of the person violating paragraph (a). `(b) Any person who violates subsection (a) of this section shall be sentenced to not less than two years or more than 10 years. If the person who witnesses or learns of the violation is the parent or guardian, or otherwise responsible for the care or supervision of the person under the age of 18 or the incompetent person, such person shall be sentenced to not less than three years or more than 20 years.'. (2) CLERICAL AMENDMENT- The table of sections for the Comprehensive Drug Abuse Prevention and Control Act of 1970 is amended by inserting after the item relating to section 423 the following new item: `Sec. 425. Failure to protect children from drug trafficking activities.'. This is ridiculous ... i would guess it would have to be unconstitutional ... i wouldn't be surprised it went through however ...This ad space for sale. minobu 0 #3 May 19, 2005 yeah I was wondering the same thing forcing someone on the threat of 2 years in prison to put their life at risk wearing a tap to help bust a drug dealer sounds pretty damn unconstitutional to me. Guest #4 May 19, 2005 In other words, you are a criminal by default, even if you are a bystander, for failing to be a stool pigeon. It's not enough for government twits to invent new ways of punishing people for doing things - now they want to punish people for the simple act of doing NOTHING. I think it would also make it easier for people to implicate others they don't like. Got a neighbor causing you grief? Just rat 'em out. Doesn't matter if they broke a law or not. A more fitting act might be a variant of "Good Samaritan" laws that indemnify those who render aid. mh ."The mouse does not know life until it is in the mouth of the cat."
