That would be an important consideration to me. People who automatically take one side, and then have to be convinced that it's wrong, are not as good a choice for judge as those who have to be convinced to take a side in the first place. I believe Scalia would make a really good chief justice. Even though I don't agree with him on his interpretation of the constitution sometimes, I think he takes each case and looks at all the facts first, before making up his mind, and he seems to be willing to listen to other points of view. Despite that fact that he may be "Chief Justice" he also is but one of nine voices on the bench. Also, as a practical standpoint, confirmation of Chief Justice at the same time as SCOTUS confirmation makes pragmatic sense. We're gonna need to confirm two new justices and a Chief Justice.
