Was it a case of dreaming of a better America, napping on the job, or just being asleep at the switch?

Serving on the highest court in the land is apparently a tiring affair for at least one Supreme Court justice who caught 40 winks on the bench, literally.

According to the Associated Press, Justice Ruth Bader Ginsberg snoozed during oral arguments today over political redistricting in Texas.


"The subject matter was extremely technical," notes AP writer Gina Holland, "and near the end of the argument Justice Ruth Bader Ginsburg dozed in her chair."

During a report by Megyn Kendall of Fox News, an artist's sketch of the hearing was aired with Ginsburg's head using the bench as a pillow.

There was no word if there was any audible snoring echoing through the esteemed chamber, but the sleep session was noticed by Bader's colleagues who made a snap judgment to let their associate continue her slumber.

"Justices David Souter and Samuel Alito, who flank the 72-year-old, looked at her but did not give her a nudge," writes Holland.

The incident caught the attention of Washington Post columnist Dana Milbank, who writes:

"At first, she appeared to be reading something in her lap. But after a while, it became clear: Ginsburg was napping on the bench. By Bloomberg News's reckoning -- not denied by a court spokeswoman -- Ginsburg's snooze lasted a quarter of an hour.

"It's lucky for Ginsburg that the Supreme Court has so far refused to allow television in the courtroom, for her visit to the land of nod would have found its way onto late-night shows."

Perhaps I'm too easy on people, but maybe Ginsburg was not feeling well. I prefer to give her the benefit of the doubt before I judge her action.

If she was feeling ill shouldn't she have excused herself from the court. Seems to me that the redistricting issue in Texas is an important issue. I know if I fell asleep in court they'd throw me out or charge me w/ contempt but , alas. I forgot, SOME PEOPLE ARE ABOVE THE LAW[:/]

Might be a pretty decent reason to excuse yourself form work...

pretty sad when a justice of the highest court falls alseep and not many seem to really care about it. I would certainly question the vailidty of any ruling at that point.

I agree. If this were Thomas or Scalia, the left would be screaming for his resignation. Because Bush would be able to appoint another conservative Judge, we won't hear the same demands.

I'm patiently waiting, it takes longer for the far right ranting to filter through the media than it does for the far left ranting (which sometimes originates in the media).

Can't say I blame her, considering the subject matter. Students napped in property law class last year fairly often.

If she doesn't participate in the ruling, I don't have a problem with it, since it would be the same as if she weren't there to begin with.

That said, napping on the bench is pretty bad form.

I agree, overall pretty bad form and she should have excused herself if she wasn't feeling well. With that said, she's been a justice for over 10 years and she apparently fell asleep once (that was reported). Big deal! Much ado about nothing.
