Judge Dismisses Suit by Man Who Says He Was Tortured
By THE ASSOCIATED PRESS

ROCKVILLE, Md. (AP) -- A federal judge dismissed a lawsuit by a German man who said he was illegally detained and tortured in overseas prisons run by the CIA, ruling that a lawsuit would improperly expose state secrets.

The ruling by U.S. District Judge T.S. Ellis III makes no determination on the validity of the claims by Khaled al-Masri, who said he was kidnapped on New Year's Eve 2003 and detained in various overseas prisons for nearly five months before finally being dumped on an abandoned road in Albania.

During his detention, he said he was beaten and sodomized with a foreign object by his captors. He also alleges that a CIA team forced him to wear a diaper, drugged him and refused to contact German authorities about his arrest.

Ellis said he was satisfied after receiving a secret written briefing from the director of central intelligence that allowing al-Masri's lawsuit to proceed would harm national security.

"In the present circumstances, al-Masri's private interests must give way to the national interest in preserving state secrets," Ellis wrote.

In my opinion, this is just all kinds of wrong. No wonder people are pissed at us.

Well, if this guy didn't want to blow shit up before, he probably wants to now.

I didn't think such a blatant denial of civil rights was possible in this country.

What the FUCK is going on in America?

I think I saw this guys story on 60 min or some other show. The show was about the CIA using unmarked planes to send people to other countries to be tutored. I guess thats there loop hole

Sad really, but not unexpected.
Everything that has been happening tells the world we only care for our own and no one else.

Then we wonder why we are so hated.:S

I wonder what the reaction would be if an American gets kidnapped tortured by the Iranian(put any hated nation here) government and then they give them the same lame excuse.

If that were true, I doubt hed be allowed to live. If he had gone through all that , Id think that he would remain quiet the rest of his life out of fear that a repeated performance. And I personally feel it would be important to preserve secrets about the CIA, their jobs , there operations ect ect....

really as if any other country doesn't just care for their own and not anyone else. The US isn't unique in that respect. Try going to Mexico and expect to be treated equally along with a Mexican citizen, or any other nation in the world.

Not at all, the American elitists don't care if other countires do it to us. The Lori Berensen case in in Peru is an example of that.

Our leaders are equal opportunity torturers.

What the FUCK is going on in America?

http://www.freedomtofascism.com/

Primary Objectives
Stop the polarization of America
Stop the domination of the Democratic and Republican parties over our political system
Shut down the Federal Reserve system
Return America's gold to Fort Knox and have it audited
Have Congress and the IRS, in a public forum, reveal the law that requires Americans to pay a direct, unapportioned tax on their labor.
Make computerized voting illegal in all 50 states
Keep the internet free and out of the control of large institutions
Rescind the law called the Real ID Act so Americans never have to carry a National ID Card
Make it illegal to implant RFID chips in human beings
Educate juries to the fact that they have the right to determine the law as well as the facts of a case
Educate juries to the fact that they are not obligated to follow the instructions of a judge
Stop Globalization because it is the path to a one world government
Protect our borders
Restore the environment
Put an end to the Patriot Act
Sign up millions of Americans so we can accomplish our objectives

Well, considering that the State Secrets Privilege was first identified by the SCOTUS in 1953, we can expect to see it here more often. See, what happens is the federal government, even if they are not a party, intervenes in a lawsuit to invoke it.

While not common, it isn't unheard of. Like anything, this is an established - if rarely used - mechanism that has developed some feet because an administration has pushed it.

I've posted over and over about how GWB is merely applying the same procedural mechanisms to get things done that started back during the Progressive movement, only seeking different objectives.
