rehmwa 2 #29 April 4, 2007 Quote Hi, it has come to my attention that there is a large farmer that has leased land in consideration for cash given.the farmer leased the land from someone else? or 'has' land that he owns and he leased it to someone? so he's pretty fat? or just tall? The period of years in the contract is over and yet he says they debt is unpaid, and there are now interest charges. this seems clear There was no interest spelled out in the contract, and the corporate farmer has now started and intimidation effort in order to steal land away. is the 'corporate farmer' also the 'large farmer' or the 'other guy' and which did the renting from who? The leased value paid was far less than the going rate by nearly half. going rate or not, who cares? the leased value was the contract right? or do you mean they only paid half and the rest is the 'debt' from your 2nd line owned to close the contract What is needed is advice, and if needed representation in order to stop the fleecing of a widowed simple elderly farmer. is this the "large farmer" the "corporate farmer" or a 3rd guy? what does his age and marital status have to do with the legality? You would be helping a man whos son recently retired after serving our nation for 23yrs in the US ARMY. more of the same, what does it have to do with the legality I think you would also get some face time on the news as being a champion of senior citizens and farmers who have had their land and livelyhoods stolen away. carrot, honey Contact me ASAP if you are interested in doing the "right" thing. IM or post is fine So here's my best guess knowing that you care for your friends and want to help someone you likely feel needs that help..... sounds like your friend owns land, leased it to an outside party, your friend was very naive and signed a very one-sided contract, the outside party hasn't paid the entire contract the outside party is trying to use present status to take the land. it sucks, the friend is someone who'd strike pity to a judge or a jury. you want to know if the "whatever" party has legal reason to take the land away from your friend. (lastly - 'intimidation effort'? physical threats, legal threats, what does this mean?) You know what I think based on this assumption? I know farmers.... Your "friend" had a contract with "other guy". They don't get along very well. "Other guy" has taken advantage of "friend" and makes late payments, etc. "Friend" realizes that he asked for too little and is trying to wiggle out of the contract or force "other guy" to pay more than required. "other guy" is pissed off about the attempt to break the contract and is unfairly trying to use the bad faith attempt to really stick it to "friend" by making his life hell, or even to take his land based on the attempts to change the original agreement. They likely only did this on a verbal agreement. And with nothing in writing, both "friend" and "other guy" have conveniently modified their memories to pitch the argument in their own favor. Neither is acting very commendable at this point. I've seen this scenario many times and many forms. Neither is very large. Neither is really a 'corporate' farmer, though "other guy" has a lot more land than 'friend' and "friend" really resents it. ...
