Family to sue Westboro Baptist Church

Recommended Posts

...and I hope they win!!

From CBS and I'm sure many other sources...hit the link for the full story.

Excerpt:
Quote

(CBS) On March 3, 2006, Marine Lance Cpl. Matthew A. Snyder was killed in the Al Anbar province of Iraq. His father, Albert Snyder, buried him on March 20 at St. John's Catholic Church in Westminster, Md.. It was supposed to be a peaceful, private ceremony.

But the funeral was interrupted by members of the church. "The protesters — Westboro Baptist Church — showed up with their signs, their hatred," Snyder said.

According to Snyder's attorney Sean Summers, the demonstrators bore their infamous "God Hates Fags" signs, as well as a lesser used "Semper Fi Fags" sign, particularly offensive to the dead Marine's family.

Though Phelps-Roper maintains that the protesters "were hundreds — hundreds — of yards from where the funeral was," Snyder was forced to travel past them to enter.

"To be honest with you, I tried not to focus on (the protest), and more on my son," he said.

But according to the lawsuit, the church's presence was emotionally damaging to the already grieving father. Postings by Phelps-Roper on the church's Web site following the protest that claimed Snyder "taught Matthew to defy his Creator, to divorce, and to commit adultery," and "raised him for the devil," further added to the father's pain.

The lawsuit says Westboro knowingly violated Snyder's privacy, defamed him and was an intentional infliction of emotional distress against the bereaved father.

In addition to general damages, the lawsuit is seeking punitive damages against the church to act as a deterrent against future protests,

I'm curious about the progress of this, as the article you linked is from July 2006.

I know that arguments have been prepared, but I don't know how to really research the progress of litigation/civil trial events.
So I try and I scream and I beg and I sigh
Just to prove I'm alive, and it's alright
'Cause tonight there's a way I'll make light of my treacherous life
Make light!

It's those ancient generators slowing everything down... actually, I came upon the story in a news crawler and wanted to find a source BESIDES Fox to appease the SC majority populace.

I think this is a very tenuous thread the plaintiffs are clinging to here. Regardless what our personal feelings may be toward the WBC, the ramifications of a successful lawsuit would be large.
It seems to me that if the WBC can be sued for their actions, so can pro-life demonstrators who emotionally damage both women using the clinic as well as the staff. Environmentalists can be accused of emotionally damaging loggers on their way to work, and what about those who yell "scab" at replacement workers?

While other have pointed out the link in your story is old, I have seen other links about it this morning, although it isn't clear to me what has changed. Here is today's NY Times:

Eventhough I do not agree with the WBC, isn't this part of their right to free speech, as protected by the US constitution? Wouldn't the winning of this lawsuit result in a serious infringement on that right?

Research the "Fighting words" exception to free speech.

mere offensiveness does not qualify as "fighting words".

Street v. New York (1969)

Was the deceased actually gay? If not, then a libel/slander suit could be in order.

Don't you just love extreme religion? It would be nice if the bible thumpers practiced what they preached. Self rightous assholes. (just this group, not all relgions)

Yep, this group is a bunch of twats but I'm not real comfortable with the whole suing for "emotional distress" thing.

Here's another idea. Get a street vendor's permit and go to wherever they're holding their demonstrations & sell eggs.;)

Just a final nail in the reasons why this case will fail.

That's what I thought untill I read this on page two..."Postings by Phelps-Roper on the church's Web site following the protest that claimed Snyder "taught Matthew to defy his Creator, to divorce, and to commit adultery," and "raised him for the devil," further added to the father's pain.

The WBC claim to be a Christian Church. I think they skipped over the 'Sermon on the Mount' and the 'Beattitudes' while reading their bibles.:S

BTW, I'm still waiting for someone on the left to tell us who they think are left-wing loons.

I think they skipped over the entire New Testament!

Those a-holes came to my town two weeks ago. I didn't know there was so many of them. Why couldn't they stay where they were? >:(

I think you answered your own question. They're a-holes.

They label themselves as 'Christians'. This proves that you can label yourself anything you want, but it doesn't make it so. Hell, I can go to any sporting goods store and buy myself a Red Sox uniform. It wouldn't make me a world champion baseball player.

Don't know if I qualify (since I don't vote democratic) but here's a partial list:

PETA
the ELF/ALF
The US Communist Party
Jesse Jackson
Matt Damon
