This is why the "legalize & tax" argument does not work ...
I disagree - it works with people brewing their own beer and making their own wine...it seems logical to believe that it would work with MJ as well.

The government will be able to enforce taxes on companies but will not be able to enfoce taxes on people and I do not believe the people that will produce their own will pay taxes. The question is, how many people will purchase from companies and how many people will produce their own?

QuoteUnbelievable? What--the police doing the job they've sworn to do--enforce the law? Oh the humanity...
Change the law or expect repercussions if you are caught violating it.
I have no problem with the cops enforcing the laws. I am just surprised that the laws are still that strict on MJ. Could a simple fine not suffice as opposed to putting someone in prison and giving him a criminal record for simply wanting to smoke a joint? By the way I do not touch the stuff so I am not just forwarding a personal agenda.
As for breaking the law and getting caught I do not deny that you are right. If I lived in the US and the laws said I could become a prison bitch for smoking a joint I would not smoke it , or I would not cry if caught. My comment is on the fact that the law requires such a harsh sentence in the first place. Could simple pssession not be like disturbing the peace or speeding? You know...a fine. Why destroy a life over a joint?

QuoteWhile it does happen, it's not nearly a prevalent as some people would have you believe. first time offenders typically get a bunch of community service.
Whether it happens regularly or not is not the point. That it happens at all is the issue.

QuoteQuoteI think you're overestimating the ambition level of most pot smokers. I mean, it's legal to brew beer at home and yet most people buy it elsewhere; I doubt that pot would be any different.
Apples and oranges really. Tending to a few plants does not seem as time consuming as home brewing. I kept a few herb plants (basil, oregano..etc) and it was no effort at all. Tried making wine and I would never go to the trouble again.
I've never grown it, but having a quick look at sites like this (http://www.greenmanspage.com/guides/growersguide.html) makes me think it's a bit more difficult to grow than basil or oregano (which are some of the easiest plants to grow).

How many smokers do you know who grow their own tobacco?

Revenue from seizures? Do the police sell on what they seize?

Have you checked in on the state of the prison system lately? Getting rid of people on dope charges is hardly going to leave wings standing empty now is it?

You pay tax when you buy the kits (or the seeds, in this case). You pay tax when you go to the smoke shop and buy an ounce.
No tax is due if you are growing and the production is for your own use.

I could be wrong. My uncle had a MJ plant although he smoked it rather infrequently so casual tending of one plant was not that big of a deal. But I will check out the link you sent me. Thanks.

How many smokers do you know who grow their own tobacco?
How many people smoke marijuana as frequently as they smoke cigarettes (assuming they are regular smokers)? The average smoker probably does not have enough garden space or time to tend to a pack-a-day habit. Unles somone is a heavy weed smoker I suspect that keeping some casual MJ on hand would not be that hard (although shotgun sent me a link which I will be looking at before I commit myself to that position).

In Florida it depends on how much you get caught with (and how that quntity is packaged as well - multiple containers implies distribution)
first time offenders, misdemeanor possesion can and DO receive: 1 year in jail, one year license suspension, $1000 fine all for posession of under 20 grams. Some people seem to typically buy an ounce, roughly 28 grams (what my buddy got caught with). Over 20 grams, felony, 5 years, $5000, 5 year suspension of license.
A guy I used to work with got caught growing recently.
He is counting on getting 5 years...that's with a perfectly clean record.
Somehow, after seeing the bitch that ran over my best friend on his bike receive only 10 years probation...the pot laws do not seem fair.

It is against the law, unless you get the TAX STAMP

How many smokers do you know who grow their own tobacco?
I'm guessing it's a small percentage of the tiny subset of smokers who roll their own.
And of course, the ROI for growing your own pot is probably much higher than for homegrown tobacco.
BTW I think it's illegal to grow your own tobacco.

Very few; MJ is illegal.
>The average smoker probably does not have enough garden space

I know quite a few people who smoke cigarettes rarely, only when they're out or in bars or whatever. None of them 'grow their own.' It's easier to buy the things. MJ, if legalized, would be no different. The reason people grow it now is not because they like growing things, it's because it's cheaper, easier and safer than buying it from a drug dealer.

No. The revenue is from the money and or property (boats, cars, houses, etc...) they seize.

Yes. You are forgetting that people on dope charges are revenue streams ... prisons don't want to remove revenue streams, they would rather expand or build new prisons.

QuoteNo. The revenue is from the money and or property (boats, cars, houses, etc...) they seize.
Taxation would be a larger and more reliable revenue stream, and would cost less to collect.

?? How much do you make out of someone sitting in prison for a year? And if people are so keen on building new jails why are the ones we have so overcrowded?

Try this out for size... my backpack is overloaded. If I take some items out of my backpack it will be less overloaded and it will be slightly easier to carry. It won't be fucking empty though will it?

Not really... It's a bit easier to hide or dispose of a small bag of weed than to do the same with a plant.

I don't make anything. Prison guards, officials, and personal (not to mention contractors) make everything. Have you every heard the saying "slash for cash"?

Well, a cop might buy the argument that a plant a quarter mile from your house "just grew there" - but he might not buy the same argument about the bag of weed in your pocket.
Unbeleivable. Here most cops turn a blind eye and the ones who do stop you merely confiscate.
