This doubble standard must END!

Why is it when a dude is walking around the house naked it's indecent exposure. But when it's a girl walking around the house naked it's "a free show"

That's exactly what the DA will have to do. This case shouldn't even go to trial. It's too bad that in Virginia they don't have preliminary (probable cause) hearings for misdemeanors; they just go directly to trial after arraignment. Maybe the DA's office will beat a sensible retreat and withdraw prosecution (prior to trial) once the publicity goes national and they're made out to look like idiots.

Yes, folks, this is the "stupid local government" story of the day.

People who know me, even just through my posts, know that that's not my attitude. And it works both ways. For every person inclined to sue at the drop of a hat, there's another person who considers every lawsuit to be frivolous. I generally don't debate the issue with people, because it inevitably devolves into having to defend against lawyer-bashing, and I have no interest in being a part of that circus.

I said what I said because: in my professional opinion, it seems, on the face of it, that the police department's and the DA's office's lack of diligent investigation and reasonable law enforcement/prosecutorial judgment may have amounted to a sufficient abuse of their authority that the arrest of this man may constitute an actionable violation of his civil rights.

its been mentioned a couple of times, could the homeowner press trespassing charges? if he was your client, would you have him take that action? why or why not? just curious. i walk around my house naked all the time. i've got down on my knees with my eyes at penis level to get a line of sight and someone would have to be on my (rented) property to see if i'm truly naked. i'm interested in the outcome of this one.

That's a good question. Usually a trespassing violation is handled with a written warning, and a citation is only issued if the trespasser returns.
Perhaps an invasion of privacy? I would feel "violated" if my neighbors were looking into my windows.

Probably not - based on the Virginia trespass statute (Here) unless (a) the homeowner had previously warned those particular people to stay off his property, and/or (b) the property was clearly posted with a "no trespassing" sign that the people are presumed to have seen and deliberately disregarded.
