I can remember when the restaurant where I worked needed to replace me after my first year of college (end of summer). The manager was looking at applications, and she said "the law says I have to take their applications and talk to them, but it sure don't say I have to hire them." Yeah, that was awhile ago, and not everyone is like that (and fewer are now). But in a world where there are still people like that (and there are), do you a. mandate equal outcome sometimes b. interfere so much in the hiring process that you guarantee equal opportunity (incredibly intrusive and expensive) c. assume that opportunity is equal and simply state that the fact that some folks don't get ahead is because of their innate inferiority I'm not about to say that I haven't seen some incredibly self-destructive sounding rhetoric coming out of some minority and welfare advocates. I'd be all for mandatory work for the majority of welfare recipients with healthy children above the age of 2 or so. But in a society with a demonstrably unfair past, what's the path to making the future more fair. It'll never be perfect -- people want to be with their friends, and almost always think their friends are more qualified. There are people living now who were denied entrance to schools because of their race, for example, and have suffered because of that. They are entitled to direct assistance (affirmative action etc.) because of the direct impact that our government's policies had on them. (And BTW that doesn't just apply to blacks - that might also have applied to the Japanese-Americans during WWII, and may apply to some Hispanics very soon.) We have most of #1, and the real problem with #2 is how do you prove that's why the discrimination happened? When making decisions like hiring someone (in most cases, made on a single-person basis, based on a number of both quantitative and qualitative criteria), it's easy to apply more weight to something that the guy who looks like you has, and to reduce the importance of whatever strength of the guy who doesn't look like you. Yeah, I know there isn't a perfect answer.
