The Government's New Right to Track Your Every Move With GPS

Recommended Posts

There are several issues to consider here. First, where is the car when the GPS is attached. Generally a driveway is considered part of the curtilage (area of property around home most protected by 4th amendment). Most courts would have a problem with attaching a GPS to a car in a driveway. Second, how is the gps attached. If it is inside a car or the vehicle had to be manipulated, that's generally a no no. Using a magnet to stick it to exposed metal is generally accepted. Finally, the biggest issue is whether it's ok to monitor a vehicle's movement by technology. On public roads this is not usually an issue as there is no expectation of privacy in a public place. If an LEO can follow in person, most courts don't have issue with using a GPS to monitor location. The tricky thing here is that GPS is always on and that it follows onto protected areas where LEOs can't. OK, shouldn't. Based on this issue having different rulings in federal appellate courts and that it is clearly covered by the fourth amendment, I agree that tuis one is destined for the SCOTUS docket.

Yep you are right... did a search an you never had a post supporting the Patriot act... but I cant find one not supporting it either.

research more carefully.

prior to today, there were 2 posts on dropzone.com made by me with the word patriot in them:

Certainly look at the patriot act! Passed in near record time. Look at the buried details. I'd think any problem that's being solved (or attempted to) by legislation can wait another 72 hours.

an implication of lack of support even when taken out of context.

Look at what happened 8 years ago with the Patriot Act .... "if you don't pass this legislation.... the terrorists win..." what a load of crap. Laws that take away rights deserve to be held up forever.

("held up" in context is clearly meaning postponed)

Sorry but a conservative Texican.... who posts vociferously on the second amendment.... apparently a supporter of capital punishment... other posts certainly on issues that are near and dear to conservatives little hearts.....

color me not convinced for non-support of Bush, Ashroft and their policies including the Patriot Act:S:S

so now you're calling me a liar? and making more assumptions... we talked about that (or I did.. you may not have understood)

I supported bush for about the first 60% of his presidency. Mostly it took me that long because I was too fucking busy to keep up with the news. I make more of an effort since.

I never supported the patriot act. If you'd actually read both of the posts I made containing the word, you might have known that. But I don't want to bother you.

uh, hang on. You've been preaching about your civil rights virtues all morning, but now you're writing that despite any evidence of the contrary, you're convinced he has evil thoughts because he hasn't provided evidence to the contrary?

how fucking American is that?

Many civil libertarians support gun rights. At least some believe in capital punishment.

Its called a BODY OF WORK

and that body is quackin and a waddlin

And I support his right to worship and say what ever he or whoever else wishes to say... in compliance with our bill of rights.

BUT I have the right to dissagree and so state... as is MY right... even though that original Bill of Rights as written by the FF did not guarantee me that right

Amazon, you are instigating and way off topic. Why don't you take the personal attacks on one another to the pm's and let the rest of us enjoy this interesting and important topic. It's unnerving muddling through the crap that all of you are posting to one another.

Are you sure you are not trying to pull a Kerry here???

You supported Bush for the first 60% of his presidency...

Sure you did not support it before you did NOT support it?

AWWWWW did that one go WHOOOOOOOOOOOOOOOOOOOOSH for ya.

I DO believe that the Bush-Kerry presidential race was within that 60% where you were in support of your fellow Texican, King George II

Remember the flip flopper mantra your fellow travellers were tossin all over the place...pertaining to Kerry in references to his supposed support of Georges Excellent Adventure?

He supported the war..... before he was against it??????

You have offered absolutely nothing productive to this thread. Perhaps you should leave it for others who would like to have a productive conversation of the topic, rather than slinging and stirring up shit. :S

You do realise how what you say makes you sound?

I'd elaborate, but Divot and Billy wouldn't be able to stop agreeing, as they know first hand.

Then offer something productive about the topic at hand.

It is the PERFECT example of the law of unintended consequences.
Any ill thought out meddling in a complex system will create unanticipated and often undesirable consequences as seen with the turd known as the Patriot Act.

It appears that those who supported said turd are having second thoughts about that support.

Pardon me while I gloat with a HUGE

I TOLD YOU SO

you know... I many times thought a couple of not-nice words about you in the above replies and kept them to myself. I decided I might have been wrong in thinking those things. It appears I wasn't.

I'll still keep my opinion to myself, but if you're trying to convince anyone you're capable of rational thought, you're going about it the wrong way.

>That's got nothing to do with tracking people without a warrant.

Such abilities could easily be used to stop foreign terrorists who have already infiltrated our country. And people like you want to do away with the Patriot Act.

It is ironic indeed that the people who supported the Bush Patriot Act are the same ones who argue so vehemently against this narrow intrusion upon personal privacy from the Patriot Act. Welcome to the bed you made.

not at all...

you remind me of this militant vegan chick I know. she's all condescending about veganism being right, and how her vegan body-builder buddy (not her husband) is such a man. All it does is stifle discussion and make any logical point she might have rendered impotent because nobody listens to what she says anymore.

She reminds me of you... I don't know if you've made any logical point because I'm really not listening anymore.

you're an intelligent man.

You'd think you'd be welcoming John to the group of people that think the patriot act is a steaming pile of shit for it's erosion of our civil rights.

Instead you crap on his newly found opinion making him pay oh so much attention to you. (oh wait... no... that was sarcasm)

You're not much into changing anyones opinions on discussion topics are you.

I would say it has a lot to do with anger management, insecurity, and coping abilities.:):D:P

Edited to add:
I responded without looking who he responded to.:)

I just assumed he was speaking about another poster here. My bad.[:/]

>Instead you crap . . .

Scatological references aside, I'm glad he's come around - and I hope he can see that the popular support of the Patriot Act (which he contributed to) led directly to this. It's too late to change this mistake, but hopefully next time he will realize that something like the Patriot Act doesn't just take away the civil rights of Muslims, foreigners and other "not-us" people.

>You're not much into changing anyones opinions on discussion topics are you.

Not really. People can believe whatever they like; I'm not going to try to change their opinions. All I can do is give mine.
