3:00PM EST: A federal judge in Florida has struck down as unconstitutional key parts of the sweeping health care reform bill championed by President Barack Obama. Officials in Florida and 25 other states are challenging sections of the Patient Protection and Affordable Care Act, including the “individual mandate” requiring most Americans to purchase health insurance in four years or face stiff penalties.

This is a case of "be careful what you wish for."

Emergency rooms will not turn away people that can't pay for healthcare.

Now, instead of forcing people to buy "some" healthcare, they won't buy any yet will still get it in emergency rooms.

Guess who actually pays for that?

Honestly, we should work on eliminating EMTALA. I don't think that is likely to happen but it is a horrible law.

if you mean the status quo, then yes, many people will be happy. No change is better than bad, expensive change.

If you mean everyone will get a health plan, and we'll all be taxed to pay for it, that takes new legislation, and that's certainly not going anywhere in the House.

The employer based method of health care will have to decay further before there is majority support for all of this.

The average person has zero hope of financially being able to pay for a heart attack just using their own finances.

A close look at this whole issue is about one thing. Judges! Judges are legislating from the bench.

My point is the right does not want judges that apply and interpret law! The right wants activists because they can not get the laws they want because they are in the minority!!! In the cases where judges make law they should be held up to scrutiny and made accountable for their actions.

it would take an activist judge to support forced purchases. A strict constructionalist is going to going to vote as the right wants here.

for all the effort spent getting this passed, they were lazy with the legal issues.

there is a difference between constitutional law and case law and many are using case law to decide cases. Case law can be turned to not represent the constition. so look in the mirror at the blithering ignorance.

Civics 101 would say that the courts should strike down such legislation, because the Constitution has explicit language.

PoliSci 101 will discuss when this really does happens, and when pigs fly as well. States' rights and equal branches of government are fantasies taught in Civics 101.
