US Supreme Court Blocks Rick Perry From Executing Man 'Based on the Color of His Skin'

Texas Governor Rick Perry uses his state’s reputation for killing without question to gain applause for his presidential bid from Tea Party audiences that cannot contain their bloodlust. Perry, the frontrunner for the Republican party’s 2012 nomination claims he “never struggled” with questions of justice and injustice, right and wrong, when it comes to approving the executions of Texans.

That’s because, Perry says, “the state of Texas has a very thoughtful, very clear process in place.”

On Thursday night, that “very thoughtful, very clear process” was due to execute the 236th inmate to die on Perry’s watch.

But the latest victim, Duane Edward Buck, had been sentenced to death after an “expert witness” told jurors in Houston that Buck posed a greater threat to public safety because he was African-American.

That racially biased sentencing process drew objections from one of the prosecutors in the case, Linda Geffin, who wrote: “I felt compelled to step forward [because] of the improper injection of race into the sentencing hearing in Mr. Buck’s case.”

Former Texas Attorney General John Cornyn, a conservative Republican who now serves on the US Senate’s Judiciary Committee, had moved to secure new hearings for defendants sentenced to death in circumstances similar to Buck’s, with Cornyn saying: “It is inappropriate to allow race to be considered as a factor in our criminal justice system.”

That said, the Supremes did right by granting a stay so the case can be reviewed concerning the statement(s) made.

I'm no Perry fan, and I think he should have required a review long, long ago. A pardon is not appropriate -- the guy is guilty as sin. A commutation is not necessarily appropriate -- a re-sentencing is utterly appropriate. The stupid statement was made during the sentencing phase, and undoubtedly was considered by the jury.

Whether he would have been sentenced to death anyway (a distinct possibility [:/]) is debatable; this was a pretty egregious crime, with children involved.

I'm glad it's turned out the way it did -- he's getting the re-review of sentencing, and it makes Perry look like a dick :P

I could see coming down on the person that used race at the sentencing hearing and havig a judge review it, but this does not make perry a dick. This make Perry look like someone that upholds the laws that the people of his state support.

He chose to allow a man to face execution knowing full well that he may not have received a fair sentence.

He refused to make the decision himself when he was in a position to do so. "Passing the buck" is a sign of a poor leader and a dick.

The same "expert" made similar statements in 5 other sentencing hearings. The other 5 were reviewed and resentenced. This one wasn't.

He's guilty as sin, and probably will end up being executed.

But having statements made by "expert witnesses" that a black man is more likely to be violent in the future because he is black is a pretty good reason to review the sentencing.
