propblast 0 #314 June 13, 2014 http://www.cnn.com/2014/06/13/politics/bowe-bergdahl-return/ The disappearance Bergdahl went missing on June 30, 2009, in Afghanistan's Paktika province, where he was deployed with the 1st Battalion, 501st Infantry Regiment, 4th Brigade Combat Team, 25th Infantry Division. Several veterans and soldiers call him a deserter who walked off his base. An Army fact-finding investigation conducted in the months after his disappearance concluded he left his outpost deliberately and of his own free will, according to an official who was briefed on the report. The Army has no definitive finding that Bergdahl deserted because that would require knowing his intent -- something officials couldn't learn without talking to the soldier, a U.S. military official told CNN. ------------ I disagree with the last part of this article from the standpoint of the oxford dictionary. Desertion does not involve intent. Being a traitor does. The oxford dictionary in my library says: Desertion: the action of leaving the armed forces illegally. ---------- Desertion is a action not a intent. BB is a deserter who may have had multitudes of other intents. Thoughts? Eta:line breaksPropblast
lummy 4 #315 June 13, 2014 The difference between AWOL and desertion is "intent". Quote AWOL [pronounced as initials or ey-wawl, ey-wol] Show IPA adjective, adverb 1. away from military duties without permission, but without the intention of deserting. http://dictionary.reference.com/browse/awol And from UCMJ The primary difference between the two offenses is "intent to remain away permanently," or if the purpose of the absence is to shirk "important duty," (such as a combat deployment).*** http://usmilitary.about.com/od/justicelawlegislation/a/awoldesertion.htmI promise not to TP Davis under canopy.. propblast 0 #316 June 13, 2014 Ok I'll buy that for a dollar. I wanted to look at it from a language point of view since English was brought up. Lets use article 85 and go down this track. Article 85 states... “(a) Any member of the armed forces who— (1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently; (2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or (3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another one of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States Note: This provision has been held not to state a separate offense by the United States Court of Military Appeals in United States v. Huff, 7 U.S.C.M.A. 247, 22 C.M.R. 37 (1956), is guilty of desertion. ----- So Bergdahl a private which I think is important to note wrote this while in captivity. "Leadership was lacking, if not non-existent," he wrote.. The conditions were bad and looked to be getting worse for the men that where actuly (sic) the ones risking thier (sic) lives from attack," he wrote. Sure seems like he decided to fall under this set of criteria at a min: Desertion with intent to avoid hazardous duty or to shirk important service. (a) That the accused quit his or her unit, organization, or other place of duty; (b) That the accused did so with the intent to avoid a certain duty or shirk a certain service; (c) That the duty to be performed was hazardous or the service important; (d) That the accused knew that he or she would be required for such duty or service; and (e) That the accused remained absent until the date alleged. And probably this set. (1) Desertion with intent to remain away permanently. (a) That the accused absented himself or herself from his or her unit, organization, or place of duty; (b) That such absence was without authority; (c) That the accused, at the time the absence began or at some time during the absence, intended to remain away from his or her unit, organization, or place of duty permanently; and (d) That the accused remained absent until the date alleged. Note: If the absence was terminated by apprehension, add the following element (e) That the accused’s absence was terminated by apprehension. Sure seems intent was there. lummy 4 #317 June 13, 2014 Yeah, it does seem like intent could be there. However, the people who investigated it, and know a lot more details than we do, couldn't determine if there was intent or not. Personally, I wouldn't think the army would give 2 promotions to the guy if they really thought he desertedI promise not to TP Davis under canopy.. propblast 0 #318 June 13, 2014 Promotions are automatic until recovery. (Based on time in grade) Which is why he did not receive the one he was pending. It is just part oft he process. Plus they will always try to recover citizens and they should as stated above. From the Washington post today- ------ On June 7, three weeks before he walked off post, Bergdahl e-mailed Harrison’s daughter, Kayla. “if at any point in time, kim gets a call from red cross, or the mill, no matter when, in a week, month, or years. . . . Keep her from panic and bad ideas. You know what I do, and ash I am still perfecting, actions may become . . . odd. No red flags. Im good. But plans have begun to form, no time line yet. . . . love you! Bowe.” Alarmed, Kayla wrote back, “Exactly what kind of plans are you thinking of?” “l1nes n0 t g00 d h3rE tell u when 1 ha ve a si coure 1ine about pl/-\ns,” Bergdahl wrote back the next day. “There is still time yet for thinking.” “Just don’t do anything stupid or pointless,” Kayla replied. “you know I plan better then that,” Bergdahl wrote back. ------ I just think a lot of folks are burying their head in the sand. I honestly would like to hear more opinions on this.Propblast
