This situation was created by a court not a legislative body.

No marriage license is a right

To date there is no LAW recognizing gay marriage

Those that push this push a private businesses baking cakes which force people to disregard their beliefs

If that is true it follows that there is no law recognizing ANY marriage. The Supremes have spoken. Gay marriage is as legal as straight marriage. Like it or not that is the law of your country. You do believe in the law and your country don't you?

Uh... I don't think you want to make a general argument that courts should not be able to tell legislatures to go pound dirt when they need to be told to go pound dirt.

That said, what impass in the sequence of events surrounding gay marriage do you consider to be "this situation"?

The reason I ask is because in many jurisdictions the existing laws governing recognized marriages were written with language that didn't preclude a gay couple being married. In some of those jurisdictions gay people just... went ahead and got married. I don't think that qualified as a "situation." A lot has happened since then, help me out.

No, this situation was created by her refusing to carry out the obligations of the office that she chose to hold.

She is the county clerk. By definition a clerical, administrative office. She does not have the right to use that office as a bully pulpit to force her beliefs on every other resident of the county. Anyone who doesn't understand that is as stupid as she is bigoted.

Can you imagine what RushMC would be saying if this clerk were Muslim, and refused to issue any certificates unless the woman was dressed modestly with her face covered? Because of her beliefs, of course.
