Another Legal Question - Neighbor McNasty

It's his property and he has the right to do whatever he wants in my opinion. Would you like it if someone chalenged you about your property and your fence? Should we go communist and have the fence police come tear it down? He has horse's and I'm sure he doesn't want someone landing and spooking them. Try another DZ that can accommodate your needs. Spaceland has 133 acers with PLENTY OUTS, and NO trees to deal with. Totally safe there. If it was me, my fence, and property? My fence would be 150ft tall, with razor wire, OUCH!B| Think about it, how would you feel if it was you?[:/]

Again this is location dependant and yes, my law prof hates me for all the what-ifs I always come up with.

Here we have municipal bylaws that govern things like how large a fence you may have. Locally it's 8'. Something like barbed wire on the top can be allowed if you have livestock but if some kid gets injured climbing over the fence then it could mean problems. My insurance co told me in no uncertain terms I couldn't put barbed wire around my business for the above reason. Instead I put up a sign that reads:

"Trespassers will be shot.
Survivors will be shot again."

All that's going to happen if you escalate matters is that he'll call the cops on a safety meeting. The dropzone is a big fat soft target and if you get his attention he'll figure out a way to screw you back.

Right on! I'm sure the guy hates the DZ with all the LOUD OBNOXIOUS music, partying and so forth. If I was this guy, I would have the Sheriff dept. there every weekend for disturbing the piece. It gets very loud there, and at night, the sound/music migrates to his piece and quiet zone! Did he move there to escape the big city BS for a little piece and quiet? Who the hell likes a LOUD OBNOXIOUS neighbor? do you? NO!

I'm going to be unpopular here but it's one thing Mc to get hyper about an occasional off landing or rare cut-away main, but this sounds like nearly every load someone was on his property. That is wrong and inconsiderate. If the DZ is using his property as a landing, or run out area then either the DZ needs more property or more accurate jumpers.
I am paying for my property and I'll not begrudge anyone to make the occasional shortcut across-but if you're in my woods every day I don't care if you're picking flowers for disadvantaged kids, I'm going to run you off.
The fence is overkill but he's not all in the wrong.



As I mentioned previously in this thread, the case that Kevin is talking about isn't an issue of using his property all the time. Maybe 1 or 2 people would land on the edge of it a weekend (average over a year) and that is considering hundreds of landings every weekend and the fact that his property is exactly up against our landing area. This particular fence has actually proven to increase the number of people landing on his property. They opt to land there over hitting the fence. The DZ doesn't need any more property, we have plenty of that and a plenty large landing area.

This particular fence doesn't even surround his property, it doesn't do anything to prevent trespassing. It is about 100yds long on half of one side of his property line. All it does is make it harder to use one of our experienced landing areas. All things aside, we would tolerate the fence, it's the barbed wire that is going to get someone seriously hurt or do damage to someones gear if they end up long in the direction of the fence.

Yes a lawyer told me we would have a reasonable claim and chance of getting the fence modified to have the barbed wire removed. Still a non-starter though $$.

This person has probably already done property damage to our dropzone, but we have no way of proving that either. It sure is interesting all the conversation this has generated. The bottom line of it is that our DZ is still a very safe place to skydive and we have a pretty damn big landing area. This change affected maybe 5-10% of the experienced jumpers at our dropzone and all it means is they have to walk an extra minute or two back to the packing area which most people already did.

How about you cut down all the power lines, all the trees! Stop all the automobiles! Ban all planes from flying over! How about you take down all light poles and fill in all swimming pools and ponds that are "potential drowning death traps"! Close the golf course, due to flying GOLF BALLS! Remove all cattle in the area you might hit while landing! Take down all buildings so that you can all land safe and party at night! Or you could go to a DZ that has plenty of landing areas with no IRATE neighbors! If the guy wants a fence, I'll would be glad to help him build one! Maybe Mc Nasty (as you call him) should look westward really hard, and take his PROBLEM to another level for disturbing the peace and trespassing! How's the neighbors south? Problem there too? He that hoots owls at night, cannot soar with eagals in the morning! Mc Nasty needs help to deal with his problem I see!
The landing area is only "damn big" from north to south! From East to West, it's itty bitty and not safe in my opinion! It wasn't to long ago, a nice lady landed in the power lines! Should you chop the power lines down to accommodate you? Well?
Jump at your own risk! Is that what the waiver says? Thought so!

He "now" jumps at SkydiveSpaceland! Home of FIVE supper duper safe otter's, TWO Cessna's Two Sky van's, and a safe landing area. Not to mention, the kick ass staff, gear, building, SMOOTH FAA APPROVED RUNWAY, eats.
Did I leave anything out? Oh, the camp site with independent electrical hook ups, and prestine grounds, kick ass video's. nice clean showers, and rest rooms. Plus their adding on 30' to their building! Spaceland? It's where you really want to be when in the Houston area. Yes, check my post for more infomation in the future!
Plus if you have money on your account there, it will be there when you return!

"disturbing the piece" is when you drop the "piece" whilst passing it to the next meeting attendee thus dumping the content of said "piece".

Example: "Ah man...you disturbed the piece. Now all we have left is the Farmer McNasty Tobaccy."

They may be keeping a low profile at Spaceland like they attempt to do on here. I hope Spaceland knows who they are dealing with there. One minute they are your friends and bad mouthing your friendly neighbors to the south, the next minute they are at another DZ doing the same thing to you. It was obvious to SDH when they started receiving blocked prank calls a couple of weeks ago that it was these guys. One of them, RC, did the same thing to Spaceland while at SDH. They talked bad about Spaceland and RC hooked his fax machine up to make calls to Spaceland to tie up their phone lines. We need people like this out of our sport. I say let them burn all of their bridges and see what happens. I wish them nothing but the best. Once they grow up and see their faults perhaps this will all end.
