mr2mk1g 10 #26 May 18, 2005 QuoteI've merely argued that goatboy has no legal standing in the state of Georgia to do anything with regards to skyride Thankfully Georgia's consumers affair office does have standing to deal with Skyrides activities within Georgia. They may therefore go on to investigate the activities that have been brought to their attention (irrespective of by whom) and prosecute using their good standing. Hooknswoop 19 #27 May 18, 2005 QuoteThe truth is, I haven't said anything defending any of skyride's actions This sounds like you are defending them: QuoteI wonder why we don't hear from many people who remained pissed off after having done their tandem whether through skyride or otherwise... Oh wait, no I don't. It's because they're all f&cking ecstatic when there feet touch the ground again. Rain checks, no refunds and 4 hour drives matter not when they have just been given the best ride of their lives (having awesome facilities, aircraft, gear, and instructors is only icing on the cake). I recently spoke with a young couple who are having a baby. Wife bought hubbie his first skydive it seems through Skyride no doubt... Then they thought they'd check out a DZ a bit closer (in the same state they live in even). First jump at ASC + trip to check out the local place = wife won't let hubbie jump anywhere but ASC, despite the drive. But I'm rambling now... The point is, Skyride deals with mostly first time jumpers, yet all the people screeching about how horrible it is are experienced jumpers who I suppose feel that their wallets would be much thicker if it weren't for skyride... This may or may not be true, but to use another analogy from the business world, does pepsi just sit around and whine when coke outsells them, hoping maybe one day a legal injunction will put them in the number 1 spot? No, they go out and aggressively advertise... You people all want to do something about skyride? Go out and aggressively promote your sport. Tell your DZO to get off his lazy ass and do the same thing. That's the only way you'll ever put a dent in skyride, and who knows, we might just find that the number of tandem riders is not finite and there really is enough of this pie to go around. Seems like you are still defending them, telling people to leave them alone. Why do you defend them when you know what they are doing is illegal? StevePhelps 0 #31 May 18, 2005 The irony to me was you misspelled in the post where you so proudly boasted on your spelling ability. I didn't think the spelling comment was necessary. To most people it was obvious you can spell and many can't ... so what. [Typical school system that says everyone must pass or else their self esteem will be lowered] I think the spelling rant distracted from the strength of your argument, but maybe that was your intent. teason 0 #32 May 19, 2005 Seeing that you know so much about the law, why is it legal/ethical for skyride to cut and paste my webpages and just change the number to theirs? Why is it justified to use my logo to advertise their number in markets I also advertise in? What makes it a person that steals a decent human being. The theft is documented, the question stands. Just curious. I would rather be a superb meteor, every atom of me in magnificent glow, than a sleepy and permanent planet.

I keep hearing this "what can we do" crap and there's obviously existing remedies that you do nothing about except post here. Copyright theft and intentianally confusing trademarks are both very serious and skyride would get reamed by a decent lawyer, you just have to find one. lawrocket 3 #40 May 20, 2005 QuoteI think if you were actually a customer of skyride's and had actually spent some money at skyride or any associated venture, you might actually have some legal standing in the state of Georgia. Otherwise, I'm sure the law (in my state anyway) would find any claim you have frivolous and without standing and therefore, yes, a WASTE of my tax dollars. Thanks. Hmm. You are forwarding some interesting legal theory that I haven't heard of. For some reason, my understanding of law (not that I have much experience with it) is that the state in which a firm has its principal place of business (bricks) has general jurisdiction over that business. The City may also take jurisdicition where the business is located. So can the County where the business is located. When interstate commerce is affected, the feds can jump in on it. And, just to add another element to it, any state where the downstream effect of the business is felt and harm occurs can alsoi assert jurisdiction. Let's say Joe from down the street says, "Hey, ninja, my son paid your sixteen year-old daughter 50 bucks for a lay. She gypped him and only gave him a hand job. Here are the pictures he took in your house." What's your response? "Hey, Joe, you have no standing to make this complaint. You don't live in my house. Your complaint is frivolous." No. This stuff is going on in your house, and you'd prefer to deal with it. Let's say Bob, Mike, Tom, and Jim tell you the same thing. If this business is doign things from Georgia that are bad, then Georgia can take a look at whats going on. My wife is hotter than your wife.
Jerry253 0 #41 May 23, 2005 It is not legal to take copyrited material and use it without the owners permission. Unfortunately, it takes money to obtain and enforce a copyright! Just about everything skyride is doing is unethical but only some of it is illegal. Sometimes you can get web hosts to drop web pages for using stolen material whether it is copyrighted on not. Copyright law has changed in recent years, favoring owners. You might want to explore that and build an argument so web hosts with not allow sites to use your work. www.copyright.gov

So, that should "show to go ya, " that we are not talking about 10th's of a cent per click, we are talking about $10,000 or more per year in sponsored link web advertising for the Yahoo ad alone!!
