what if he pushes you while trying to take your bag of peanuts at a sports event where you were wearing the visiting teams colors? Again I would need to know more. If you and I are at a game and a heated exchange starts which results in one of us shoving the other then no it is not a felony. If some guy wants my peanuts and demands them and then shoves me to take them then it is a robbery by force. I would call that serious. It is the line between committing force vs not committing force. And in this guys case he has a history of being trouble so it is best to get rid of him. I think what makes the "felony" charge acceptable to me is that he used force while committing theft. Stealing via deceipt, sneakiness or even being a fast runner is one thing. Once you prograss to using physical force to say "I am taking this like it or not or I will hurt you" and even exerting force against the person trying to protect their property then you are no longer guilty of a minor crime and have become a thug. This is why I beleive the guy should have a very long time out. He is irrideemable. The solution to that disparity is not to weaken the sentence for 3 strikes violations but to increase the sentence for murder. As for giving this guy life, don't most life sentences give you the option of paroling after 25ish for good behaviour? I could be wrong, I don't know for sure but it just seems that some individuals are irredeemably and unremorsefully criminal. If we are willing to give this guy healthy food while he is put away and a roof over his head (better than most homeless who have committed no crime have it) then maybe it's for the best. He will feel at home amongst like minded individuals, will want for nothing and we will not have to worry about what he is up to anymore. Alternately I am open to suggestions as to how you would deal with habitual criminals who just never seem to change. The issue is that even with multiple convictions this guy cannot respect other peoples property or their right to not be assaulted (and yes shoving is assault). By doing so he also expressed a willingness to use force (threat) to commit the crime of theft so that makes it robbery by force (not sure what the actual legal term is for it). He has had more than enough fair chances, I think society could use a very long break from this guy. No, but shoving is still an assault (even if there is no injury). It is the use of force against another person. If this guy was a one time offender who just snapped then I might have some sympathy but guys like this never seem to change (yes I realize that there are exceptions). Three strikes sounds pretty fair. It gives a person 3 chances and as someone previously pointed out many can go an entire lifetime without a single strike. If this guy still can't figure out that he cannot steal and use force to get what he wants then he does not belong in society. I am not suggesting cruelty, I am fine with him being fed well there but if he gets back out he will continue to re-offend, so he should be put away. The guys sounds like a career scumbag. He has had plenty of chances. I am not suggesting that they do anything cruel to him, just put him away .....for good. Society is better off without him. Vancouver is a more laid back scene. Nightclubs tend to be more live band than DJ and most people are into outdoor activities and relaxing in a pub. Parties usually happen at private locations or booze cans. However, excelent climbing, some of the best scuba in the world on vancouver island apparently and......beautifull scenery for jumping. If the person is of sound mind and wants to die then yes it is their choice. Someone who is mentally unstable might not be able to make an informed choice and needs to be restrained. President Ronald Reagan was surrounded by, arguably, the most well trained and armed security team on the planet. All of that ability to defend him did not stop John Hinkly Jr. from trying to "impress" Jodie Foster. The person with the first shot usually has the advantage. Self defense FROM gunfire WITH gunfire seems nearly futile. So if they were not there he would have lived anyway? I do find it to be an irritating policy and would prefer to be able to walk out of Costco without them checking me. That said, if it is such a problem then people do have choices and can shop elsewhere. You have a point in that it should be made abundantly clear to shoppers before they enter. By nature I rarely fight something on principle alone (otherwise I would spend my whole life fighting). Unless something is really putting me out of my way and seems unreasonable I will usually just grin and bear it. I guess it is about personal limits. I usually find that the things people will challenge are not worth the effort of challenging and often have valid reasons. For example, you as a professor have to acept assignments from students, and you may or may not choose to use turnitin.com but do you see the justification in students challenging it legally? Personally I always liked when that honesty was enforced. Regarding this receipt policy it may be distastefull and while they really should inform customers in advance, why not just shop elsewhere and let the stores that do that suffer from the lost sales. Most importantly, why take it out on the poor security guy who is just doing his job for minimum wage? That's the problem with most bar-room lawyers and wannabe-johnny-cochrane constitution thumpers. They like to challenge even reasonable restrictions which benefit us all. Any attempt to try to curtail behaviour that hurts us all is fear mongered as the first step on a slippery slope to neo-fascism. If people are so upset by this stores policy then shop elsewhere. I like enforced rules because all too frequently people gain advantage over me by breaking rules that I abide by. Rules (and enforcement of those rules) are designed to try to create fairness. I frequently question the motives of those who challenge rules designed to create fairness. I suspect boxing is a good one (although I sucked at it). Anything overly exotic with too many variants of kicks/flips/chops/holds/pressure-points violates the Keep-it-simple rule. Something not overly artsy but more full contact is good so he is used to getting hit and having to get himself out of a corner. I really do not know enough about the oriental martial arts to give an opinion one way or another on those so my bias will be boxing. How huge of a problem is this at the pre-school level? Wow...go google the term "straw man arguments". I hardly think a reasonable person could so blatantly misconstrue my arguments as being an opposition to our very freedoms. The store is free to conduct business however they wish, and those who do not like it are free to shop somewhere else. What specific comment did I make that left you with the impression that I wished to live in a fascist or communist dictatorship? By tech-store-nazi do you mean the poor guy who is just doing his job for minimum wage? Why? The costs of theft are passed on to the consumer and by doing what they are doing they are both trying to prevent that and protect themselves (which they at least should have the right to do). Why would it bother you so much to show a receipt? It's not like he is demanding a DNA sample. Is this really such an issue or is it about showing off your knowledge of the law? Because there is a gaurd at the front door and people are under the impression that he can stop them from stealing. If bar-room lawyers make it known that he canot then another easy avenue of theft is now openned up Probably because most people would not sue a company for trying to protect itself against theft particularly since they were only inconvenienced long enough to show that they paid for the goods they are walking out with. Most people would be willing to understand why they need to do that. Neither is allowing shoplifting losses. Look if it bothers you that much then shop somewhere else. Why stir up shit for these people? I am sure these guys understand basic marketting and would not impose upon customers like that unless their experiences dictated that it was neccessary. I don't mind the posts actually (so long as people are not knocking on my door to convert me). I was not brought up with any religion whatsoever which I sometimes regret. As a result I have a fascination with it and usually question people like Stevorino at length when the topic comes up. I don't see this as directly comparable. The issue you describe is one of placing a higher value on one animals life than another. The issue here is one of needless animal cruelty purely for entertainment purposes which cannot be compared to the neccessary slaughter (presumaby as humane as possible) of animals for consumption or products. Staggering. I guess I stand corrected on that one. My only defence on my mistake is that nobody I know beleives that, and I associate with pretty average people. Again that is frightenning. I don't know what to say. How can someone possibly not know that? Then that is a pretty sad statement about our society. I really thought better of the average person.
