That is basically my point. Perhaps I did a lousy job of articulating it. I have already said on this thread that if both were impaired to the point where they could not make rational decisions then she is not a victim and he is not a criminal. My thought was that if he is of sound mind and it is obvious that she isn't then he is crossing the line. I was also making the point that if he is sober she does not have to be passed out for it to be rape. If she is stunbling all over the place and making no sense and generally being an embarrasment, then she is not in command of her faculties even if she is conscious. That would qualify as rape. There still needs to be some kind of a line drawn. Even if someone is capable of speaking, sometimes it is painfully obvious that the persons behaviour indicates that they are too drunk to make intelligent decisions. Even if she is saying yes, if it is obvious that that is the alcohol speaking and she is not in any condition to be aware of the ramifications of her decisions, and likely would not be having sex with the guy otherwise, then he is still in the wrong if he has sex with her. Not enough facts in the case. I am of mixed opinion on this. Since voluntary intoxication does not mitigate a persons responsibility for their actions I think a person should use their brain and not let themselves be inebriated to the point of not being aware of their actions. That said there is an ethical line that must be drawn in the sand. If a girl has had a few drinks which have obviously loosened her inhibitions somewhat then I feel she is still capable of making an informed decion. On the other side of this argument the girl shouldn't have to be so drunk that she is passed out unconcscious before it can be called rape either. A girl who is brainfucked on alcohol can still be standing and even coming on to you but if you are of reasonably clear mind and it is evident that she is clearly gooned then even if she is making the advances you have an obligation to not take advantage of the situation. Her own stupidity is not an excuse on the guys part and her consent (or advances) do not qualify as informed consent. If both parties were two braindead to even remember having sex and happen to wake up together then you have a different situation. I believe there is a god but I will never know what the "right" religion is. I wish these "ours is the right religion" people could tell me why if I dedicate my life to doing what I to the best of my ability beleive he wants, God would punish me with eternal burning for having the misfortune of being taught the wrong version of the same story. I've had it before. I am not 100% sure but I seem to recall hearing that the infection can have some negative effect on your kidneys so rather than just riding it out you might want to go see a doctor just to be safe. I have heard different about how the law operates on this but then the laws in Canada may differ in that respect in the US. Perhaps one of the lawyers on this forum could clear this up. I have a hard time beleiving that a court could penalize a person who acted in what they beleived was good faith with the intention of preventing harm. In most cases I would agree but there would be situations where I beleive a peson has a moral obligation to inform someone about potential danger. If I feel that someone will harm someone (again it depends on the person) I care about I am not going to keep my mouth quiet. What if someone you knew to be both infected and irresponsible was dating someone in your family. Would you let this person you knew to be willing to endanger others harm someone you cared about because of an overwhelming dedication to this guys privacy? What if it was your sister? Your daughter? I would not. Nice try there sunshine. I never said freinds. I simply said I have known people who have bragged about it. Does knowing someone automatically make that person your freind? I spent many years in lower wage jobs and ran across all sorts on construction sites. Random chit chat occurs and I have on occasions heard people talk about their exploits (not sure why they thought any of us cared to hear it). I never at any point chose to associate with these guys. Should I have quit my job to avoid these people? You are personalizing this issue when you don't need to. First unless I am somehow in a position where I would be obliged to respect confidentiality (your doctor or someone who for professional reasons needs to know that you have it) I suspect you would have a hard time suing me for repeating something that I am aware of. That said if I knew you as a person my decison to respect your confidentiality would depend on what I thought of your character. I say this because I know guys who have bragged about having sex with girls in bars while having STD's (not HIV but chlamydia the clap ...etc) so I am perfectly aware that there are some people who are remoresless when it comes to their sexual gratification. So if I kew you as a good freind and I knew you were a responsible person who would never dream of endangering someone by withholding info then I would mind my own business. If I did not know you personally or if I knew you were the kind of guy that I described above then I would make sure to let a freind know if I saw you getting flirty. I would not apologie for that. Shit, that's news to me! I get calls all the friggin time. When I tell them I am on the list and will sue their ass, they don't call back. So that's good. I have heard differing feedback on this. I am sure he can find a way. The race card always finds a way. Even in my own life I recall we were taught by our parents and teachers that racism was wrong and we would get in deep crap at school for the slightest racial comment yet it was open season on gays and this was acceptable. Our gym teachers and rugby coaches thought nothing of making comments about a guys sexual preference if he underperformed at something physical. We could openly make gay jokes in the presence of our teachers, yet would not dare tell a black joke. Hate to burst your bubble but blacks to not hold the franchise on being oppressed, as much as some of them would like to portray it that way. They are one of many minority groups, of which all have suffered discrimination/oppression. Apparently the one in the US works so hopefully it will work here. It still allows research surveys, political canvassing and charities. Once you put your name on the list, firms have 30 days to include you on their do-not-call list. After that if you receive a call, the telemarketer can get a $1500 fine and the firm a $15,000 fine. I will pursue complaints against anyone who calls me after the 30 day period. Whats worse is many of these pricks have "private caller" show up on my call display so if I am waiting for an important call I have to pick up. Even when I can screen the calls it seems to go off repeatedly throughout the day. Just the constant ringing and the effort to stop what I am working on to check the call display is driving me crazy due to the frequency. Ouch. I have heard some economists make this argument but do we really want to do that to lower skilled workers? I am sure somone can point out a study with a big econometric model that says this is good but what about the human factor? What are the negative side effects of this? I agree with keeping minimum wage in check so as to encourage people to invest in their human capital ( and not squeeze people out of employment), but not having any? How will this impact inner city ghetto families that are already struggling to make ends meet? Oh, and I agree completely with the other reccomendations. Riiiight. We all technically can fit into some definition of special interest. I am Irish/Scottish and you know how the english treated us. Damnit I want compensation. I be a victim, i be opressed because de man be keepin me down. Hey this whole victim thing is fun. As a matter of fact, I am only an A liscence and have been looked down on by some B's C's and whatnot.......damnit the DZ owes me compensation!! I think this just shows that the rules apply to everyone equally which I think was a good call. So, no I do not think that gay trumps black but it equates to black. This is a sore point to many black people. I have heard many a time that there are several in the black community who hate the comparison of homo-phobia to racism against blacks. I have also met several who have made this argument to me. Apparently the argument is that blcak people did not choose their skin colour while gays chose their lifestyle (their words not mine). Personally I just think some people just don't like sharing the special interest pie. I can't help but feel that the occupied lands, and palestinian matter are just red herrings for the larger hatred for any existence of Isreal, so I do not think it would be a good idea for all groups to live together equally in Isreal. It is a tiny peice of territory why can they just not have it, and let the palestinians have their territory? The creation of the jewish homeland stemmed from the recognition that without a "home base" for jews they would always be at risk of persecution, without refuge. Isreal is the one place in the world that is theirs and where they will always be welcome if they face persecution. If Jews were not the ones running Isreal they would ultimately be run out of isreal. Well he knew how wrong he was, so it is not a surprise that he did not want this in the public eye. By keeping as much of a lid on it as possible he also made sure that the public would be in the dark about how the matter was dealt with. Too much transparency would have made it harder to play the race card after the fact I suppose.
