  1. I've experienced the same thing by moving from Sprint to Verizon. Verizon has delivered fine service when I travel but absolutely unacceptable service here in Chicago. I think now I'll pay Verizon's early termination penalty and go back with Cingular, which gave me relatively excellent performance a few years ago (I had dropped Cingular due to frequent billing irregularities, particularly when I was traveling). 2. A few years back Dreamsville and I were bedecked knights, complete with coconuts for galloping effect, in an unmentionable society's rendition of the search for the Holy Grail. I've been looking forward to seeing this show, thanks for confirming it will be worthwhile. D. James Nahikian CHICAGO
  3. I'm too ugly for you to stalk me on the ground and too fast for you to catch me in the air. D. James Nahikian CHICAGO
  4. No. My identity is cleverly concealed. (I feel for you Kevin; good luck.)
  5. I was armed only with carabiners, some line, a maglite and a pen from the hotel. Javelinas 1, Nahikian 0. D. James Nahikian CHICAGO
  6. Me too. But alas, there was more excitement during my expedition (verbatim e-mail description follows): J: I was out of town when you called on Sat. Solo climbed and hiked the Catalina Mountains in Arizona looking for ramhorn sheep - in the freakin' rain and with mini-waterfalls trying to hose me. Also got 'ambushed' by a 'marauding hoard' of javelinas - sixty to ninety pound rodents that look like pigs but have 2 inch incisors and a bad attitude. Probably smelled a half-eaten Luna bar I was carrying and like chocolate. Let's talk this week. D I've since learned that javelinas are _somewhat_ smaller than '90 lbs' - they looked like bears to me in the rain D. James Nahikian CHICAGO
  7. A few weeks ago I had to wade across this just to reach the trailhead ... D. James Nahikian CHICAGO
  8. I am pondering how this could serve as a guide to fun at our dropzone ... hmmm. D. James Nahikian CHICAGO
  9. I hope that you may redeem them at a manicurist near you. What a nasty-looking hangnail ... D. James Nahikian CHICAGO
  10. Thanks Ed. Thanks ____, you nameless private message fiend who did the 1999-2000 night jump 'rollover' with me and HagenDaz (how is that guy and his SO doing BTW?). D. James Nahikian CHICAGO
  11. Ron and Norm, what a terrific spread in the January 2005 Parachutist. (pp.24-9.) Thank you for covering one of our sport’s premier winter events with your in-depth account and extraordinary photos. Are invitations required in order to participate next year? D. James Nahikian CHICAGO
  12. Consider you have an injunction in your pocket that is founded solely on the Georgia statute. Skyride reorganizes as a Caymans holding shell which owns another business entity that is headquartered in some other Carribean nation. This entity relocates its server and service operations to, say, Madras India. Bear in mind these steps are shockingly easy and relatively cheap to accomplish. Question: your Georgia injunction and damages award are worth what in terms of their utility? D. James Nahikian CHICAGO
  13. That's true today. In fact, it's custom to display both the symbol and the word together. Copyright doctrine doesn't acknowledge the ubiquitous '(C)' yet, it's too recent D. James Nahikian CHICAGO
  14. Addendum: the 'C' parenthetical, (C), does not constitute notice of copyright. Only a true 'circle C' can perform this function. D. James Nahikian CHICAGO
  15. Under federal law, assuming you took the photo on your own time, used your own resources and did not snap the photo within the scope of an employment arrangement then you would probably own the work automatically upon depressing the camera trigger. You would be the author and sole rightsholder in the photo. Merely posting the photo on a website or elsewhere typically wouldn't constitute license for others to make use of your work, though the fair use provision of the Copyright Act might apply and relieve an unauthorized infringer from liability. (depends on the use) Notice gives you certain unofficial presumptions in certain U.S. courts and formal legal rights in some other countries. What the paperwork, plus ~$30, gives you is constructive notice to infringers and access to the federal courts. Otherwise, subject to rare exceptions, you can't allege copyright claims in a federal complaint, and for most purposes federal copyright is the only game in town. Consult with your attorney. D. 16. Don't mix your apples with your oranges. While common law and state trademark is alive and well, common law copyright has been preempted by the federal statutes and it is dead for the instant purposes. I renew my claim that plaintiffs will need to have registered and submitted their deposit copies in advance of lodging any copyright claims given the facts posted here and at Jan's website. Follow the advice of your personal attorney, which I am not. D. James Nahikian CHICAGO
  17. I won't challenge these assertions. Of course, you'll need suitable plaintiffs to stand behind the complaint, marshall the evidence, post bond (assuming preliminary injunction) and help defray the expenses. Also, plaintiffs will need to have registered and submitted deposit copies of their works with the Office prior to alleging copyright infringement in the complaint (you may be able to amend the complaint and add copyright claims subsequent to filing it). Then you're stuck with the stigma associated with being a skydiver who sues other skydivers I suppose. D. James Nahikian CHICAGO
  18. I track every dime, though I take great care not to enter a state where I 'know the price of every thing yet appreciate the value of no thing.' D. James Nahikian CHICAGO
  19. I'll stay tuned on this channel D. James Nahikian CHICAGO
  20. By what theory did you dismiss 15 USC 1125? I'm curious regarding your reasoning. For ease of reference: (a) Civil action (1) Any person who, on or in connection with any goods or services, or any container for goods, uses in commerce any word, term, name, symbol, or device, or any combination thereof, or any false designation of origin, false or misleading description of fact, or false or misleading representation of fact, which— (A) is likely to cause confusion, or to cause mistake, or to deceive as to the affiliation, connection, or association of such person with another person, or as to the origin, sponsorship, or approval of his or her goods, services, or commercial activities by another person, or (B) in commercial advertising or promotion, misrepresents the nature, characteristics, qualities, or geographic origin of his or her or another person’s goods, services, or commercial activities, shall be liable in a civil action by any person who believes that he or she is or is likely to be damaged by such act. 21. Thanks for the PMs. D. James Nahikian CHICAGO
  22. I'll be staying on basse terre for three days during the Christmas holiday respite. Summiting la soufriere and canyoning the chutes on day one. Diving off malendure on day two. This leaves day three open. Is there any organized skydiving operation on Guadeloupe? Details appreciated. Merci à l'avance de votre hospitalité aimable. D. James Nahikian CHICAGO
  23. I'm planning a solo day hike in the Tucson area for this Sunday starting around daybreak. Finger Rock to Mt. Kimball sounds fine though I will be grateful for your informed recommendations. Mainly seeking vistas while avoiding crowds and dogs. Thx in advance. D. James Nahikian CHICAGO
  24. OMG I just realized what Sunny's preparing to swallow _is not Jello!_ Aaaack! D. James Nahikian CHICAGO
